In June/July of this year, Daniel and Cristina Mooney were summoned to court without Santa Rita's legal representation inquiring about what The Mooney's availability was or when they were available. This is a violation of the NM Laws of Procedure. After this violation was pointed out to Domenici Law Firm, they straightened up a little and took our availability into consideration for depositions (statements). On July 9th and 10th, Daniel and Cristina were badgered for 2 hours separately by Domenici Law Firm, Gary and Sally Blum during the depositions. The deposition with Daniel on July 10th went over the allotted time and Domenici Law Firm would not allow Daniel to leave on time which caused him to not be able to attend an interview for a job, which resulted in more loss of income for the Mooney family as a result of the discrimination, violations of NM Laws, and harassment carried out by Domenici Law Firm on behalf of and in conjunction with Santa Rita Land and Cattle Company.
In August, Daniel and Cristina Mooney discovered that the well Santa Rita has been allowing hundreds of people to use is not only unmetered (violation of the rules outlined by the State Engineers Officer) but it was never permitted when it was originally drilled. This just goes to speak to the lack of regard for the law and the merits of this unlicensed real estate company.
To make matters increasingly stressful, a neighbor that recently purchased the last lot in our culdesac from Santa Rita, openly trespassed on our property a few weeks ago. This man felt it was ok for him to walk onto our property and open our shipping container that was purposely damaged by Cibola County Sheriff's Department in March 2018. He admitted to Daniel and Cristina (on camera) that he had trespassed on the property several times and "just wanted to see what was inside the container." As you can see, the discrimination and harassment from associates of Santa Rita, and potential members of The Mujeres Militia in the Mujeres Ranch Subdivision are not stopping their harassment and campaign to get "people like us" out of "their subdivision". As a reminder, this "militia" is made up of people from Southern states that fly Confederate flags and have made comments like "Go see the gun-toting Rastas at the end of the road!"
On top of our storage being broken into and our privacy violated, again, there has been an increase in strange vehicles ignoring the 15+ Private Property signs on both sides of our private easement and driving onto our driveway without permission or purpose. These vehicles drive the roads in the dark of night with their lights off which is very suspicious, and they never stop to have a conversation with the Mooney's. Anytime these vehicles are spotted or approached they take off in the opposite direction. Ongoing harassment.
The next hearing that has been scheduled (it will need to be confirmed because the court hasn't sent us any information confirming this date) is on October 25th at 9 am. We encourage any supporters in New Mexico to attend at the District Court in Grants, New Mexico.
