Following the launch of this petition in June, I met Sharon Kemp, RMBC Chief Executive, on 26 July for more than two hours. I offered to withdraw my requests to the ICO (Information Commissioner’s Office) asking them to investigate RMBC for failure to provide requested information on 16.9.15 (yes more than two years ago) if Sharon agreed to insist that officers tell me the truth. Sharon declined my offer and said she would prefer the ICO to deal with it first ... Here is part of today’s update from the ICO … watch this space: 2 November 2017 FOIA request to Rotherham Metropolitan Borough Council dated 26 October 2015 ... I now understand that you believe further relevant documents may be held by the Council which have not been disclosed. What happens now Where possible the Information Commissioner (“the Commissioner”) prefers complaints to be resolved informally and we ask both parties to be open to compromise. With this in mind, I will write to the public authority and ask it to revisit your request. It may wish to reverse or amend its position. If it does, it will contact you again directly about this. In any event, it must provide us with its full and final arguments in support of its position. Once I receive its arguments, I will consider its reply before providing you with our conclusion. Further information is available on our website: www.ico.org.uk/FOI-complainants-guide The request On 26 October 2015 you requested the following information (in respect of an earlier FOIA request that you submitted on 16 September 2015): Please provide the information generated when processing this FoI request (the metadata) which includes the internal notes, emails etc. The scope of the case The focus of my investigation will be to determine whether the Council handled your request in accordance with the FOIA.
