In response to an email requesting clarification on the legal authority of the Council over this issue I received, in part, the following, "Officially the horn is part of the Cochran Hose Company operation. The horn was purchased by the Borough in 1959 and given to them."
This position, which is less definitive than what was expressed at the meeting, should properly leave the Council with all normal legal authority. It, therefore, seems to provide the option of returning to the Council and requesting the passage of an ordinance of some sort if the status quo is unreasonably maintained.
I will add that, according to what was read on Monday, in 1959 when the horn was purchased a primary reason for this purchase was to provide the town with an air raid siren.
