Պահանջում ենք անհապաղ ազատ արձակել Վարդգես Գասպարիին

Սույն թվականի փետրվարի 19-ին Շենգավիթ վարչական շրջանի ընդհանուր իրավասության դատարանի ակնհայտ անօրինական և ոչ իրավաչափ որոշմամբ կալանավորվել է Վարդգես Գասպարին: Վարդգես Գասպարին քաղաքացիական հստակ դիրքորոշում ունեցող անձ է, ով բարձրաձայնում է Հայաստանում մարդու իրավունքների հետ կապված խնդիրները, և իր դիրքորոշումն արտահայտելու համար բազմիցս հայտնվել է իրավապահ մարմինների թիրախում: Մի երկրում, որտեղ ներկայիս և ապագա սերունդների դեմ ծանրագույն հանցանքների համար ոչ ոք պատասխանատվության չի ենթարկվում, նման ճակատային գործելաոճը և հանցագործների առջև դեմ հանդիման կանգնելը մեծ խիզախում է:

Վարդգես Գասպարիի դեմ դատավարությունների ներկայիս շղթան սկսվել է վարչական պատասխանատվության ենթարկելու վերաբերյալ ոստիկանության ներկայացրած հայցերից։ Դատավարության ընթացքում Գասպարին և իր փաստաբանները օրենքով սահմանված պաշտպանական տարբեր միջոցներից շարունակաբար զրկվել են, մասնավորապես՝ մերժվել են նրանց բազմաթիվ միջնորդությունները, առարկությունները և այլն։ Գասպարին արդարացիորեն արտահայտել է իր անվստահությունը դատարանին և ցուցադրել անհնազանդություն մի մարմնի, որը ոչ միայն իրեն է զրկում պաշտպանվելու բոլոր միջոցներից, այլև հանրության մեջ չունի արդարադատություն իրականացնող անկախ կառույցի  հեղինակություն։  Պայքարի նրա որդեգրած մոտեցումները ամենևին չեն կարող որակվել որպես «վիրավորանք» և չեն կարող հետապնդվել կալանավորմամբ:  

Մենք՝ ՀՀ և այլ երկրների քաղաքացիներս, ՀՀ նախագահի պաշտոնը զբաղեցնող Սերժ Սարգսյանից, ՀՀ գլխավոր դատախազի պաշտոնը զբաղեցնող Գևորգ Կոստանյանից և ՀՀ արդարադատության նախարարի պաշտոնը զբաղեցնող Արփինե Հովհաննիսյանից  պահանջում ենք անհապաղ միջոցներ ձեռնարկել՝ Վարդգես Գասպարիին ազատ արձակելու ուղղությամբ:

Միաժամանակ,  կոչ ենք անում հանրությանը ինքնակազմակերպվել և բոլոր  հնարավոր միջոցով սատարել Վարդգես Գասպարիին, ում քաղաքացիական անհնազանդության գործողություններն օրինակելի են և ուղղված են  Հայաստանի ցանկացած քաղաքացու իրավունքների պաշտպանությանը։

Release Vartgez Gaspari!

On February 19, 2016, citizen of Armenia and civic activist Vartgez Gaspari was detained by the glaringly illegal and disproportionate verdict of the Shengavit Court of General Jurisdiction, Yerevan, Armenia. Vartgez Gaspari is known for his unequivocal political position, he often speaks out on human rights offences in Armenia, and has numerously been persecuted for his activism. His straightforward opposition to public authorities is a courageous stance in a country where usually no one is held responsible for even as massive crimes, as ones against the present and future generations.

The current chain of persecutions against Gaspari began with police suits for administrative charges related to freedom of assembly. During the trial, Gaspari and his attorneys were continuously rejected legally prescribed remedies such as motions, objections, etc. Gaspari expressed his lack of confidence to the Court and chose a strategy of disobedience and non-cooperation, stating that the Court not only deprives him of defence opportunities but also enjoys zero public trust as an independent institution. His methods of struggle can by no means be labeled as “contempt of court”.

We, citizens of Armenia and other countries, demand that Serj Sargsyan holding the post of the President of Armenia; Gevorg Kostanyan, holding the post of the Chief Prosecutor of Armenia; and Arpineh Hovhannisyan, holding the post of the Minister of Justice of Armenia immediately take measures to release Vartgez Gaspari.

At the same time, we call upon members of the society to self-organize and support Vartgez Gaspari by all possible means. His actions of civil disobedience are exemplary for all and are in the name of protecting the rights of every citizen of Armenia.
