As of the new year, sadly, we lost our first appeal. This decision was made by the appellate courts due to our argument not being "strong enough".
After that decision, we had 90 days to file the necessary paperwork to keep all legal proceedings moving forward.
Two days before the paperwork was due, Brian's current state appointed attorney sent me an e-mail stating that she was "not going to file the necessary paperwork that was due. Sorry and good luck!"
As you can imagine, I made phone calls all day long and was able to get in touch with someone who reached out to our attorney. Shortly later, I received an e-mail that she was going to file the paperwork. Later in that week, I received a package in the mail containing ALL of my husbands case files.
This, among other signs, is one that clearly states that she no longer has the time or the energy to put into our case that it so desperately needs.
At this time, Brian and I are still currently researching to find someone that could help him.
Different projects and groups that we have contacted have informed us that they only deal with non-violent or non-serious crimes and/or DNA exoneration.
I urge everyone to please, sign and re-post my petition. Help Brian and me get the word out that there are major flaws in California's judicial system.
Also, if anyone has any advice or suggestions, please contact me via Facebook through Free Brian Clay Green.
Thank you for all of your support!
