Florida Representative Frank Artiles has submitted an amendment to HB 583 - Single-Sex Public Facilities. This bill is still anti-transgender and should be voted against. Sex is now considered “biological sex” or the sex on license or passport, rather than sex assigned at birth. Exceptions now apply to people who need assistance using the facilities and to their guardians. An exception also applies if that single-sex facility is the only one “reasonably available.” Beyond these exceptions, the punishment for using a multi-person single-sex facility of the other sex is still a misdemeanor, but of the second degree, rather than of the first degree.
These have eased some concerns people had about this bill. However, this bill should not be considered acceptable even with these revisions. Using the restroom is still not a crime! Changing the legal sex on one’s license and/or passport can be difficult, time-consuming, costly, and even impossible depending on where one was born and from where one received their identification. Underage transgender people, above the age of requiring assistance in the restroom but often not in the position to legally change their sex, are particularly vulnerable. People shouldn’t need to show their papers to pee!
