Save Tyre’s Natural Reserve

Associations working for the protection of the environment and heritage, as well as civil society organizations in Tyre,

categorically reject the ongoing commercial project on a 400,000 m² area of public land, adjacent to the Tyre Nature Reserve in Jeftlik Ras El Ain, which was established under Law No. 708 of 11/5/1998.

According to available information, the government granted the Ministry of Defense the right to occupy several properties—including those involved in this project. These properties in Jeftlek Ras al-Ain - Tyre are: 1504, 1570, 1571, 1572, 1573, 1574, 1575, 1197, and 1198 in the Shawakeer area, as well as property No. 640 in the Kharab area. The initial purpose of this occupation was strictly defensive, military, and temporary. However, the Ministry of Defense signed an agreement with "SIS" company under the BOT (Build-Operate-Transfer) mechanism, granting it the right to exploit these lands.

This project plans the construction of 150 shops, restaurants, and apartments, which the investor will operate for 28 years, in exchange for establishing a maritime club for officers on one of these plots and the public beach of the Reserve.

Why Must the Project Be Stopped Immediately?

• An Imminent Threat to Archaeological Heritage: Numerous archaeological studies have confirmed that the historic land port of Tyre (Palea-Tyre) is buried beneath the Tyre Nature Reserve, extending between Tell Al-Rachidiya and Tell Al-Maachouk. Any construction or installation of sanitation networks in this area is prohibited, in accordance with UNESCO's 1999 decision, reference WHC-99/CONF.204/15.
• Violation of Public Property Law: The Ministry of Defense has exceeded the conditions for the occupancy of public property by relinquishing its rights to a private company without an official decree.
• Violates the Antiquities Law: Construction work was carried out without the approval of the Directorate General of Antiquities, despite the discovery of significant artifacts at the site.
• Breaches Protected Areas Laws: The project includes prohibited constructions according to environmental laws and the area's master plan.
• Violates the Building Law: Work commenced without legal permits or approvals from the relevant authorities.
• Neglects the Environmental Protection Law: The project includes constructions prohibited by environmental laws and the master plan for the region.
• Breaches the Public Procurement Law: The project was not submitted to the Public Procurement Authority as required by legal procedures.
• Violates the Right to Access Information Law: Project documents were not disclosed to the relevant authorities, despite not being classified as national defense secrets.

Our Demands:

• Immediate cessation of all ongoing works at the site.
• Disclosure of contracts, documents, and maps related to the project.
• Relocation of the Officers’ Club project to an alternative site that complies with environmental laws and preserves the area's natural and cultural character.
• Commitment to protecting the Tyre Nature Reserve and enforcing applicable laws without exceptions.

Sauvez la Réserve Naturelle de Tyr

Les associations œuvrant pour la protection de l'environnement et du patrimoine ainsi que les organisations de la société civile à Tyr

rejettent catégoriquement le projet commercial en cours sur une superficie de400 000 m²de biens publics, accolé à la Réserve Naturelle de Tyr, à Jeftlik Ras El Ain, créée en vertu de la loi n° 708 du 5/11/1998.

Selon les informations disponibles, l’État a accordé au ministère de la Défense nationale le droit d’occuper plusieurs parcelles, y compris celles concernées par ce projet, à savoir : Jeftlik Ras El Ain - Tyr: 

1504, 1570, 1571, 1572, 1573, 1574, 1575, 1197, 1198 (zone de Chawakir), ainsi que la parcelle n° 640 

(zone de Kharab). L’objectif initial de cette occupation était strictement défensif et militaire, et temporaire. Cependant, le ministère de la Défense a signé un accord avec la société "SIS" selon le mécanisme BOT 

(Build-Operate-Transfer), lui accordant un droit d’exploitation sur ces terrains.

Ce projet prévoit la construction de 150 magasins et restaurants ainsi que des appartements, que l’investisseur exploitera pendant 28 ans, en contrepartie d’assurer un club maritime pour les officiers sur l’une de ces parcelles et la plage publique de la Réserve.

Pourquoi devons-nous arrêter ce projet immédiatement ?

• Un danger imminent pour le patrimoine archéologique : De nombreuses études archéologiques ont confirmé que le port terrestre historique de Tyr (Palea-Tyr) est enfoui sous la réserve naturelle de Tyr, s’étendant entre Tell Al-Rachidiya et Tell Al-Maachouk, où toute construction et installation de réseaux d’assainissement sont interdites, conformément à la décision de l’UNESCO de 1999, référence WHC-99/CONF.204/15..
• Violation de la loi sur les biens publics : Le ministère de la Défense a dépassé les conditions d’occupation des biens publics en cédant ses droits à une entreprise privée sans décret officiel.
• Infraction à la loi sur les antiquités : Des travaux de construction ont été réalisés sans l’approbation de la Direction générale des antiquités, malgré la découverte de vestiges importants sur le site.
• Non-respect des lois sur les zones protégées : Le projet comprend des constructions interdites par les lois environnementales et le plan directeur de la région.
• Violation du Code de l’urbanisme : Les travaux ont débuté sans permis légal ni autorisation des autorités compétentes.
• Non-respect de la loi sur la protection de l’environnement : Aucune étude d’impact environnemental n’a été réalisée et aucune consultation publique des habitants n’a eu lieu.
• Violation de la loi sur les marchés publics : Le projet n’a pas été soumis à l’Autorité des marchés publics, contrairement aux exigences légales.
• Atteinte au droit d’accès à l’information : Les documents du projet n’ont pas été communiqués aux instances concernées, bien qu’ils ne relèvent pas du secret défense.

Nos revendications

• Arrêt immédiat des travaux sur le site.
• Divulgation des contrats, documents et plans liés au projet.
• Déplacement du club des officiers vers un site alternatif, respectueux des lois environnementales et du caractère naturel et culturel de la région.
• Respect intégral de la Réserve naturelle de Tyr et application des lois en vigueur, sans exception.
