SYNOPSIS OF CONSTITUENTS OF NEW SEWICKLEY TOWNSHIP V. BOARD OF SUPERVISORS OF NEW SEWICKLEY TOWNSHIP AND MEADOWCREST LP 

  New Sewickley Township prides itself on natural beauty. From corner to corner, high and low, rural and agricultural roots are dug deep into its land and people. This is the reason people choose to live and stay here. This is the reason people choose to raise families here, many farms are 3rd and 4th generations. But that may change.

 

 Now, Meadowcrest LP, a community developer, seeks to profit from New Sewickley’s natural landscape. Meadowcrest intends to build 222 home units along Klein Road, spanning and razing ~95 acres of land. To support its proposal Meadowcrest submitted its planned residential development application to the New Sewickley Board of Supervisors on December 19, 2023. If successful in their efforts, the character of New Sewickley is going to be irreversibly changed. 


 But the community has come together to object to this development. Yet, this has not been enough to persuade New Sewickley. Despite strong community opposition at the Board of Supervisors public hearing on April 24, 2024, the Board of Supervisors approved the development in a narrow 3-2 decision. 


 On July 19, 2024, twelve of those residents came together and appealed the Board of Supervisors’ decision to the Beaver County Court of Common Pleas. Legal briefs were submitted, and the argument on those points was scheduled for January 3, 2025.  A decision in the residents’ favor would have stopped the development in its tracks. 


 A fourteen-hundred-page certified record was submitted to the Court of Common Pleas for review and consideration in its rulings, and legal arguments were made without any questions or concerns from the court. The same day of argument, the Court handed down a decision from the bench in favor of Meadowcrest and against the New Sewickley residents.

 

The residents’ next, and only, step is to appeal to the Commonwealth Court of Pennsylvania and petition the Commonwealth Court to reverse the Board of Supervisors’ and Court of Common Pleas’ decision. These efforts have kept development at bay and needs further support in order to see that development never breaks ground.
