We received a certified letter from the board yesterday. It indicated that they would be willing to trespass on our property and remove the statues that they claim are in violation of their architectural rules. They also threatened to fine us and put a lien on our home.
In the letter, they claimed that they enclosed forms to fill out for approval. Those forms were not included. However, in their emails to us they told us that even if we filled out these forms the board would not allow us to have these statues.
The Declaration of covenants clearly indicates the process for alleged violations. The board has not followed this process. They claim that we are in violation I've installing architectural items without approval. However, as we all know, statues are not architectural. They then stated that we are in violation of making exterior modifications without approval. However, that terminology is not in our covenants. If that is the case, then we have $235 photographs of other exterior modifications in the neighborhood including statues, signs, bird baths and things of that nature that have not been addressed by the board.
There are certain items that are not allowed in this subdivision. Statues are not one of those items. The board is clearly engaging in harassment and selective enforcement. We have also been harassed by the adult son of the board president.
Please continue to share this petition and make others aware of the hostile, toxic environment that this homeowner's board has created in our home. By the way, our County pays the second highest property taxes in the nation.
If the statues affect property value in the neighborhood then why did our taxes go up 14.7% this year?
