There is an illegal housing unit that connects through 910 and 914 S Mariposa that currently has tenants.
SB 35 Section 7 states: The development is not located on a site where any of the following apply:
(iii) Housing that has been occupied by tenants within the past 10 years.
SB 35 Section 7 (iii) requires that all proposed developments must comply with all zoning laws and other land use requirements, and not violate any current agreements or orders. This means that housing that has been used illegally, and therefore in violation of the existing zoning laws and regulations, would not be eligible for streamlined approval under SB 35.
If there are any illegal structures or housing units on the proposed development site, the developer would need to address those issues and seek any required permits to make the structure or unit completely legal before applying for streamlined approval under SB 35. Also, it is possible that existing violations could affect eligibility for SB 35 on the development site, even if they are not related to housing.
