High Court Enforcement Officers have been sent to Shepherd’s Bush Market under the instruction of U+I Group Plc. in seeking rent payments and High Court Enforcement Officers fees of hundreds of pounds from market traders. However, the incorrect issuing of the CRAR Notices (Commercial Rent Arrears Recovery Notice) to traders and failing to provide the legally required 7 days notice in advance, has meant that the High Court Enforcement Officers have acted unlawfully.
The developer’s attempts to alarm the traders, without giving the legal required notice and the High Court Enforcement Officers’ threats towards traders is viewed as a breach of covenant, compromising the leaseholders’ rights of 'quiet enjoyment' of their premises.
The solicitors of the Shepherd’s Bush Market Tenants’ Association have written to U+I Group Plc.’s solicitor, stating that those sums which were unlawfully demanded and paid to the High Court Enforcement Officers, must be immediately refunded back to the affected traders.
These shocking tactics to panic and scare traders are viewed as bullying and an attack to cause further duress on the livelihoods of the small market businesses of Shepherd’s Bush Market.
A recent report published and approved by the Hammersmith & Fulham Council entertains prospects of partnering with U+I Group Plc. on future developments however, there may be ethical concerns from many as to whether the Hammersmith & Fulham Council should associate themselves so closely with U+I Group Plc. and their conduct.
