Respected His Lordship Justice Bhushan Gavai,

We are writing to you with the deepest respect and hope amidst deep concern and urgency regarding the Hon’ble Supreme Court’s recent directive to remove all stray dogs from the Delhi NCR region into shelters within eight weeks. As per news reports, the Hon’ble Supreme Court has issued directions to build shelter homes installed with CCTV cameras that ensure no dog is ever released. Your lordship not only is this order in direct contradiction of the laid down laws that only provision confinement for a maximum time of 10 days when stray dogs are picked up for sterilization and to provide them with post operative care.


As the citizens of this wonderful country who care about our environment and animals, we have waited for almost two decades for stray dogs to get their right to live on the streets and be allowed access to food and water as provisioned by the law. Infact, we are the only country that premises on compassion and humanity, and demonstrate a detailed understanding of how animals, in particular street dogs, behave and act. This premise is acknowledged by our judiciary, lawmakers as well leading to what we now refer to as the ABC rules, 2023.

It is our earnest request to seek an urgent review of today’s (11 August) order also because: 

1. Our right to intervene has been taken away; our constitutional right has been taken away. 

2. Today’s order comes from a lower bench and is not in alignment with the CJI’s bench order that mandated that ABC rules, 2023 be followed. 

3. The Central Government waited 15 years to establish the ABC rules, 2023 and this is the law that governs welfare and all other issues regarding stray dogs. Can these rules be disregarded so brutally? 

4. Suo moto cognizance taken based on a media report and no effort made to verify the facts of the media report – but parents of child is confirmed that the child died due “meningitis” 

We are law abiding citizens of this country and feed stray dogs from our own personal f inances and bear hardships only because of our compassion. It has now become common to face harassment, mental trauma and emotional distress by others who regularly vilify us despite our rights as feeders and caregivers to be protected under the law.


We urge the Hon’ble Court to review the said order and uphold the ABC rules, 2023 which are formulated after decades of court hearings and are in line with scientific consensus, humanitarian grounds and as well as constitutional ethos.
