The Issue

Courts are making life-changing medical decisions without neutral doctors insight from medical panels. Bill S1102: An Act Establishing Medical Panels For The Probate and Family Courts Filed By: Senator Feeney can help to guide judges in complex medical cases.

Every day, Probate & Family Courts make decisions affecting:

• Children
• Elders
• People with disabilities
• Survivors of domestic violence
• Families in crisis

Many of these cases involve serious medical issues, yet  judges are often forced to make decisions without neutral medical guidance.

Bill S.1102 fixes this.

A Personal Reason This Bill Matters:

In 2013, I lost my 24-year-old disabled sister, Fantasia, to a preventable heartbreaking tragedy caused by caregiver neglect from an in-home care company. This happened while I was working to secure guardianship and care for her myself.

I believe that if independent medical panels had existed, the process could have been clearer, faster, and possibly life-saving.

My sister might still be here today.

This bill is about making sure no other family experiences that kind of loss.

In Loving Memory of: Fantasia Robinson, September 1988 to June 2013

What S.1102 Will Do

Allows judges to appoint an independent panel of at least three board-certified physicians to provide neutral medical findings in cases involving:

  • Guardianship
  • Conservatorship
  • Custody
  • Medical Cases

Why This Matters

✔ Objective, unbiased medical insight

✔ Fewer costly expert battles

✔ Faster, more informed decisions

✔ Reduce risk to vulnerable individuals of all ages

✔ Help prevent avoidable tragedies

Massachusetts already uses similar medical panels successfully in disability retirement cases. This proven model used for decades should also protect families.
