SAVE BUBBA and STEWIE-they don't deserve to die!
The Issue
What Happened:
Following a single, isolated neighborhood incident involving stray cats on October 29, HPD labeled them dangerous and ordered their destruction on November 13. This unjust order was appealed in the San Benito County Superior Court, where Commissioner Galloway egregiously overlooked critical evidence. HPD is using your tax dollars to kill our pets! The court permitted emotional testimony from individuals who did not even witness the event, while completely ignoring 11 sworn character statements—including three sworn statements from area kennels and an evaluation from a 20-year master dog professional.
We need your signature right now to demand that City Leadership step in, stop this massive waste of taxpayer dollars, and halt this irreversible execution before time runs out.
Betrayal of Upstanding Citizens: The Piersons are 15-year residents, youth coaches, FFA/Ag Booster members, and volunteer in local non-profit organizations that raise scholarship money. Both children (a Hollister High sophomore and 2nd yr Cal POLY student). Both girls are/were Baler ASB student athletes, Girl Scouts and Honor Students. They are having a tough time understanding why being an upstanding citizen that contributes to their town means nothing to a police department and court system determined to kill their pets.
Why this is a gross administrative overreach:
1) Based on Speculative Hearsay: The entire case relies on speculative hearsay from a single passerby. No video, audio, or sworn testimony of the onset of the incident and physical facts prove there was no blood or tissue found on either dog.
2) Proven Safe: Just two days after the incident, over 200 neighborhood children trick-or-treated right at our front door on Halloween with absolutely zero incidents.
3) Restitution Made: We have already taken full accountability and made complete financial and personal restitution with one of the cat owners.
4) No Physical Evidence: Physical facts directly contradict the claims. No blood or tissue was found on either dog. One cat ran away completely under its own power, and the other was a known, highly aggressive feral animal.
5) Biased Judicial Overreach: In court, Commissioner Galloway permitted emotional testimony from people who weren’t even present. Her decision did not acknowledge eight sworn statements from neighbors and a comprehensive evaluation by a 20-year professional dog trainer. Filed with the court in support of Bubba and Stewie.
6) Expert Testimony Silenced: The court completely ignored 8 sworn neighbor statements, 2 sworn statements from local kennels, sworn testimony from a local groomer and a comprehensive safety evaluation from a 20-year master dog professional, prioritizing narrative over sworn evidence.
7) Severe Due Process Violations: HPD withheld critical incident reports until less than 24 hours before the initial November 13 hearing, violating the family's constitutional right to mount a defense. An HPD Sergeant then absurdly claimed he could read the dogs' minds, declaring that standard puppy training certificates meant the dogs were "trained to kill."
8) Foolproof Structural Security: The family has already completely rebuilt their property gate with inward-opening hinges and a human-operated thumb-latch, physically guaranteeing that any future accidental escape is completely impossible.
9) Massive Waste of Taxpayer Funds: On numerous occasions HPD has deployed up to 6 law enforcement officers at a time to the Pierson residence to handle this routine civil pet matter, pulling vital emergency response units away from real crime prevention in Hollister. HPD has Lozano Smith (city attorneys) representing them at the expense of the tax payers!!
This is a blatant misuse of Hollister law enforcement and taxpayer dollars. We are pleading for the Hollister City Council and Manager step in, pause the execution, Amend the Dangerous Dog declaration to "animal at large" and halt all actions/efforts by Lozano Smith in pursuit of this case.
