IOPC decision
I have concluded that the outcome of your complaint WAS NOT reasonable and
proportionate. Therefore your application for review is UPHELD.

When making my decision, I have considered:
▪ Your original complaint dated 19 February 2024.
▪ Your application for review submission dated 28 March 2024.
▪ Supplementary material you have sent in support of your application, included in both
emails dated 10 April 2024

In your application for review submission, dated 28 March 2024, you stated that South
Yorkshire Police, in a previous complaint, had determined that a call you had made to the
police was handled correctly and the IOPC had agreed with these findings. However, in an
outcome to a further complaint, the force has now determined that the call you made to the
police was not correctly handled and should have been dealt with as a missing person
rather than Right Care Right Person (RCRP). You stated that the coroner determined your
ex-partner had sadly passed away that day. You feel that the mishandling of the call
caused a delay in services finding Mr Gillatt which therefore could have potentially cost
their life.
You explained that you would like public acknowledgement of the mistake by the police
and the IOPC as well as an apology. You also stated that you are considering suing the
police for negligence as, had you not made a second complaint, the error made by the
police and IOPC would not have been discovered.

I have therefore determined that it is necessary to recommend, as a remedy, that South
Yorkshire Police provide a reasonable and proportionate outcome to you. Following this
outcome, you should be provided with a right to a review of that decision.
It would be for South Yorkshire Police to determine how they communicate this outcome to
you. However, I would like to suggest to the force that they contact you during the process
and provide you with an explanation, and apology if the force deems this necessary, for
any confusion caused during this complaint process.
