Revoke Section 33 (Notwithstanding Clause) of the Charter of Rights and Freedoms

The Issue

In our country of Canada, the fundemental rights of all citizens must be respected. So then, why is it that the Charter of Rights and Freedoms contains a notwithstanding clause (Section 33) which allows provincial parliaments to overrule the fundamental rights we are given within sections 2 and 7-15. This allows provincial governments to pass laws that take away the freedoms that  give us equity, safety, freedom from discrimination, and protect us within the judicial system.

 

This clause has also been used to pass Bill 21 in Quebec, which infringes upon our fundamental right to freedom of religion as outlined in Section 15. This bill restricts bus drivers, first responders, teachers, lawyers, and other proffesions from expressing their faith through religious attire or icons such as crosses, hijabs and turbans, whilst working.

The use of this clause is not only an affront to our democratic values but also undermines the very essence of our charter which aims at protecting individual rights and freedoms. This should not be allows. Therefore, it's time we stand together against such misuse that threatens our societal fabric.

Let us call upon the federal government to repeal Section 33 from the Charter of Rights and Freedoms. Let's ensure that no government can take away these fundamental rights again under any circumstances.
