Subject: Request for Compliance with the Court Ruling Granting Rights to the Marañón River and its Tributaries

Dear authorities,

We are reaching out in support of Huaynakana Kamatahuara Kana, the Kukama Indigenous Women’s Federation of the Marañon and Samiria Rivers, to request compliance with the recent ruling confirmed by the Civil Chamber of the Loreto Court, which upholds the decision issued in March this year by the Mixed Court of Nauta, recognizing the Marañón River as a rights-holder in alignment with our Indigenous worldview.

This historic decision is a fundamental step toward protecting our natural resources and preserving the ancestral connection of the Kukama people with the Marañón River. However, this ruling goes beyond our people; it represents an action in favor of the Amazon and the biodiversity of the region.

Through this letter, we urge the Peruvian State, and specifically the entities named in the lawsuit, to comply with the provisions of the ruling, including:

The protection, conservation, maintenance, and sustainable use of the Marañón River and its tributaries, in line with the rights now recognized as part of the river’s legal standing.

Effective, immediate, and comprehensive maintenance of the Norperuano Pipeline, as an urgent measure to prevent future hydrocarbon spills that threaten the integrity of the Marañón ecosystem.

The establishment of watershed councils for the Marañón River and its tributaries, as ordered by the ruling, with their institutionalization led by the Regional Government of Loreto, involving the National Water Authority and local community representatives.

The designation of defenders and representatives for the Marañón River, who will be responsible for safeguarding its rights and acting on its behalf in future judicial proceedings.

The Loreto Court ruling reflects the joint efforts of our communities and allies who have fought for years for the protection of our environment. Today, with this judicial support, the State has both the opportunity and the responsibility to fulfill this historic mandate.

We trust that the Peruvian authorities will act in accordance with the law and in favor of the rights granted to the Marañón River and the peoples who depend on its well-being for their sustenance and culture.

Asunto: Solicitud de cumplimiento de la sentencia que otorga derechos al río Marañón y sus afluentes

Estimadas autoridades,

Nos dirigimos a ustedes en apoyo a la Federación Huaynakana Kamatahuara Kana y de la Federacion Kukama de Mujeres Indigenas para solicitar el cumplimiento de la reciente sentencia confirmada por la Sala Civil de la Corte de Loreto, la cual ratifica el fallo emitido en marzo de este año por el Juzgado Mixto de Nauta, reconociendo al río Marañón como titular de derechos, en consonancia con nuestra cosmovisión indígena.

Esta decisión histórica es un paso fundamental hacia la protección de nuestros recursos naturales y la preservación de la conexión ancestral del pueblo Kukama con el río Marañón. Sin embargo, esta sentencia no se limita a nuestro pueblo, sino que representa una acción en favor de la Amazonía y de la biodiversidad de la región.

A través de esta carta, instamos al Estado peruano, y en particular a las entidades demandadas en el proceso, a cumplir con lo dispuesto en la sentencia, incluyendo:
1. La protección, conservación, mantenimiento y uso sostenible del río Marañón y sus afluentes, considerando los derechos que ahora se le reconocen como sujeto de derecho.
2. El mantenimiento efectivo, inmediato e integral del Oleoducto Norperuano, como medida urgente para evitar futuros derrames de hidrocarburos que pongan en riesgo la integridad del ecosistema del Marañón.
3. La creación de los consejos de cuenca para el río Marañón y sus afluentes, tal como dispone la sentencia, y su institucionalización a través de una convocatoria liderada por el Gobierno Regional de Loreto, con la participación de la Autoridad Nacional del Agua y representantes de las comunidades locales.
4. La designación de defensores y representantes del río Marañón, quienes puedan velar por la defensa de sus derechos y actuar en su representación en futuros procesos judiciales.

La sentencia de la Corte de Loreto es un reflejo del esfuerzo conjunto de nuestras comunidades y de los aliados que, durante años, hemos luchado por la protección de nuestro entorno. Hoy, con este respaldo judicial, el Estado tiene la oportunidad y la responsabilidad de cumplir este mandato histórico.

Confiamos en que las autoridades peruanas actuarán en respeto a la ley y en favor de los derechos reconocidos al río Marañón y de los pueblos que dependen de su bienestar para su sustento y cultura.
