The Issue

I am a proud holder of a Nepalese passport and citizenship, currently living outside my home country holding a permanent residency of foreign country. Like many others in similar situations, I find myself deprived of the fundamental right to vote in my nation's elections. This is not just about me; it's about all Nepalese citizens who are residing abroad for various reasons - education, employment or other personal circumstances. Nepalese citizens only can vote when they are within the territory and even nepalese citizens holding green card and permanent residency of different country cannot vote in general elections if they present for vote. 

Active participation in general elections is crucial for shaping the political landscape. Ensuring your voice is heard through voting is a fundamental way to influence the direction of your country's leadership. It's an important reminder to engage in the democratic process and hold leaders accountable through the power of the ballot.

I am  proposing a comprehensive approach to address key issues in Nepal's governance through a democratic process of referendum. These issues are: 

1. **Publicly elected executive of state or Not?**: This question addresses the structure of the executive branch, whether it should be directly elected by the people or follow a different method of selection.

2. **Abolishing the state parliament or pausing the function state government for 10 years?**: This raises the issue of whether the current state parliament should be abolished or if its functions should be suspended for a specific period.

3. **Existing 7 states or adopting previous 5 development regions?**: This concerns the administrative divisions of Nepal, debating between maintaining the current seven states or reverting to the previous five development regions.

4. **Nepal as Hindu state or Not?**: This revolves around the official status of Hinduism within the state, whether Nepal should remain a Hindu state or adopt a secular stance.

5. **Even the need of religious Monarchy or not?**: This addresses the role of monarchy in Nepal's governance, questioning the necessity and relevance of a religious monarchy in contemporary Nepal.

Each of these issues is crucial and can significantly shape Nepal's future. A referendum could be a democratic way to gauge public opinion and make decisions on these matters. It's important to ensure that all Nepalese, regardless of their location, have the opportunity to participate in the referendum to truly reflect the will of the people. Additionally, thorough discussions and education about these issues would be essential to ensure informed decision-making among the populace.

Voting rights are indeed fundamental and ensuring fair access for citizens, regardless of their temporary migration, is crucial for a democratic process. Legal frameworks should consider the rights of citizens even when temporarily residing outside their home country. Nepalese new constitution also secured voting rights of Nepalese citizens wherever they live. The Supreme Court of Nepal has ordered Election commission of Nepal to ensure voting rights of Nepalese living abroad. The Election commission has got summoned from Supreme Court not implementing the orders of Supreme Court. Election commission is blaming Nepal government not providing funds for this purpose. 

It's important for countries to ensure that their citizens living abroad have the opportunity to participate in elections and maintain their rights as citizens. Providing avenues for overseas citizens to engage in the political process helps ensure their voices are heard and their interests represented, especially considering the significant number of Nepalese nationals living overseas. Governments can explore mechanisms such as absentee voting or electronic voting to facilitate participation while addressing logistical challenges.

As per the International IDEA (Institute for Democracy and Electoral Assistance), as of 2017, 115 countries and territories around the world have provisions allowing their citizens living abroad to vote. However, Nepal is yet to join this list.


There are 9 million Nepalese living out of country including SAARC countries . The time has come for Nepal to reconsider its stance on this issue. By denying voting rights to its overseas residents holding valid citizenships and passports, we are excluding  9 million of our population from participating in our democracy. 

We urge the Government of Nepal and relevant authorities to establish voting rights for all Nepalese living out-of-country while holding valid Nepalese passports & citizenships. Let us strengthen our democracy by including every voice that has a stake in shaping our nation's future. We need to pressure Nepal government to allocate funds in next budget to the Election commission of Nepal to conduct absentee voting for Nepalese living abroad.

म नेपाली राहदानी र नागरिकता गर्वले बोकेर हिँड्दै  छु । हाल म , मेरो देश बाहिर बस्दैछु। यस्तै परिस्थितिहरूमा अरू धेरैजस्तै, म पनि मेरो राष्ट्रको चुनावमा मतदान गर्ने मौलिक अधिकारबाट वञ्चित भएको छु। यो  शिक्षा, रोजगारी वा अन्य व्यक्तिगत परिस्थितिहरू  र विभिन्न  कारणहरूले अस्थायी रूपमा विदेशमा बसोबास गर्ने सबै नेपाली नागरिकहरूको बारेमा हो । अंझ ग्रिनकार्ड र पीआर हुने नेपाली नागारिकले त नेपालमा मतदानमा भागलीन पाऊदैनन् र आफू बसेको देशमा नागरिक नभैकन मतदान  गर्नै कुरो भएन । नेपालको  कानुन यसबारेमा विभेदकारी छ ।

राजनीतिक परिदृश्यलाई आकार दिन आम निर्वाचनमा सक्रिय सहभागिता महत्वपूर्ण हुन्छ । मतदान मार्फत तपाईंको आवाज सुनिएको सुनिश्चित गर्नु तपाईंको देशको नेतृत्वको दिशालाई प्रभाव पार्ने आधारभूत तरिका हो। लोकतान्त्रिक प्रक्रियामा संलग्न हुनु र मतपत्रको शक्ति मार्फत नेताहरूलाई जवाफदेही बनाउनु महत्त्वपूर्ण अनुस्मारक हो।

लोकतान्त्रिक प्रक्रिया मार्फत नेपालको शासन व्यवस्थाका प्रमुख मुद्दाहरूलाई जनमतसंग्रह मार्फत   सम्बोधन गर्न व्यापक दृष्टिकोणको प्रस्ताव गरेको छु।


1. राज्यले  जनताद्वारा प्रत्यक्ष निर्वाचित कार्यकारिणी  प्रमुख रोज्ने की   होइन?**: यो प्रश्नले कार्यकारी शाखाको संरचनालाई सम्बोधन गर्दछ, चाहे यो प्रत्यक्ष जनताद्वारा निर्वाचित हुनुपर्छ वा चयनको फरक विधि अपनाउनुपर्छ।

२. **प्रदेश संसद खारेज गर्ने वा प्रदेश सरकारको काम १० वर्षका लागि स्थगित गर्ने?**: यसले वर्तमान प्रदेश संसद् खारेज गर्ने वा निश्चित अवधिका लागि त्यसको काम कारबाही स्थगित गर्ने भन्ने प्रश्न उठेको छ।

३. **अवस्थित ७ वटा प्रदेश वा अघिल्ला ५ विकास क्षेत्रलाई अपनाउने ?**: यसले नेपालको प्रशासनिक विभाजनसँग सम्बन्धित छ, हालको सात राज्यलाई कायम राख्ने वा अघिल्ला हरेक  प्रदेश  भारत चिन जोडिने    ५ विकास क्षेत्रहरूमा फर्काउने भन्ने विषयमा छलफल हुन्छ।

4. **नेपाल हिन्दू राज्य हो कि होइन?**: यो राज्य भित्र हिन्दू धर्मको आधिकारिक हैसियतको वरिपरि घुम्छ, चाहे नेपाल हिन्दू राष्ट्र रहनु पर्छ वा धर्मनिरपेक्ष अडान लिनु पर्छ।

५. **धार्मिक राजतन्त्रको आवश्यकता पनि हो कि पर्दैन?**: यसले नेपालको शासन व्यवस्थामा राजतन्त्रको भूमिकालाई सम्बोधन गर्दछ, जसले समकालीन नेपालमा धार्मिक राजतन्त्रको आवश्यकता र सान्दर्भिकतामाथि प्रश्न उठाएको छ।

यी प्रत्येक मुद्दा महत्त्वपूर्ण छ र यसले नेपालको भविष्यलाई महत्त्वपूर्ण रूपमा आकार दिन सक्छ। जनमत संग्रह जनताको राय नाप्ने र यी विषयमा निर्णय गर्ने लोकतान्त्रिक तरिका हुन सक्छ। यो सुनिश्चित गर्न महत्त्वपूर्ण छ कि सबै नेपालीले चाहे जुनसुकै स्थानमा भए पनि जनताको इच्छालाई साँच्चै प्रतिबिम्बित गर्न जनमत संग्रहमा भाग लिने अवसर  पाउनुपर्छ । थप रूपमा, जनताका बीचमा सूचित निर्णय गर्ने सुनिश्चित गर्न यी मुद्दाहरूको बारेमा गहन छलफल र शिक्षा आवश्यक हुनेछ।

मतदान अधिकार साँच्चै मौलिक हो र नागरिकहरूको लागि निष्पक्ष पहुँच सुनिश्चित गर्नु, तिनीहरूको अस्थायी बसाइसराइको बाबजुद, लोकतान्त्रिक प्रक्रियाको लागि महत्त्वपूर्ण छ। कानुनी ढाँचाहरूले आफ्नो देश बाहिर अस्थायी रूपमा बस्दा पनि नागरिकहरूको अधिकारलाई विचार गर्नुपर्छ।
विदेशमा बस्ने आफ्ना नागरिकहरूले निर्वाचनमा भाग लिने र नागरिकको रूपमा आफ्नो अधिकार कायम राख्ने अवसर पाउनु देशहरूको लागि महत्त्वपूर्ण छ। बिदेश बस्ने  आफ्ना  नागरिकलाई   राजनीतिक प्रक्रियामा संलग्न हुनका लागि अवसरहरू प्रदान गर्नाले उनीहरूको आवाज सुनिएको र उनीहरूको हितको प्रतिनिधित्व सुनिश्चित गर्न मद्दत गर्दछ  । विशेष गरी विदेशमा रहेका नेपाली नागरिकहरूको उल्लेखनीय संख्यालाई विचार  गरेर  सरकारहरूले मागलाई  सम्बोधन गर्दा सहभागितालाई सहज बनाउनको  लागि अनुपस्थित मतदान वा इलेक्ट्रोनिक मतदान जस्ता संयन्त्रहरू अन्वेषण गर्न सक्छन्।

इन्टरनेशनल आइडिया (इन्स्टिच्युट फर डेमोक्रेसी एण्ड इलेक्टोरल असिस्टेन्ट) का अनुसार २०१७ सम्म विश्वका ११५ देश र क्षेत्रले विदेशमा बस्ने आफ्ना नागरिकलाई मतदान गर्न दिने प्रावधान छ। तर, नेपाल अझै यो सूचीमा परेको छैन ।

सार्क राष्ट्र लगायत देशबाहिर ९० लाख नेपाली  नागरिक रहेका छन् । यस विषयमा नेपालले आफ्नो अडानमा पुनर्विचार गर्ने बेला आएको छ । वैध नागरिकता र राहदानी बोकेका  नेपाली  नागरिकलाई मतदानको अधिकारबाट वञ्चित गरेर हामीले हाम्रो प्रजातन्त्रमा ९० लाख जनसंख्यालाई सहभागी हुनबाट वञ्चित गरिरहेका छौं ।

मान्य नेपाली राहदानी र नागरिकता लिएर देश बाहिर बसोबास गर्ने सबै नेपालीलाई मतदानको अधिकार सुनिश्चित गर्न नेपाल सरकार र सम्बन्धित निकायलाई आग्रह गर्दछौं। हाम्रो राष्ट्रको भविष्यलाई आकार दिने हरेक आवाजलाई समेटेर हाम्रो लोकतन्त्रलाई बलियो बनाऔं।विदेशमा रहेका नेपाली हरु ले मताधिकार प्रयोग गर्न पाउन आगामी बजेटमा बजेट विनियोजन गर्न नेपाल सरकारलाई दबाब दिनुपर्छ ।

यदि तपाईं सबै नागरिकहरूको लागि समान मतदान अधिकारमा विश्वास गर्नुहुन्छ भने तिनीहरू अस्थायी रूपमा बसोबास गर्ने ठाउँमा भए पनि कृपया यो याचिकामा हस्ताक्षर गर्नुहोस्।
