Require full legal disclosure of marriage terms before issuing licenses
Require full legal disclosure of marriage terms before issuing licenses
The Issue
When I got married, I thought I was signing a simple license to make my relationship legally recognized. I never imagined that signature bound me to hundreds of hidden legal obligations—financial, contractual, and personal—buried across state and federal statutes I had never seen.
Only years later did I realize what I had agreed to: that marriage is not just a commitment between two people but a pre-written contract drafted entirely by the state, with terms no one discloses at the time you sign. These terms govern your property, debt, income, estate, taxes, and even your right to privacy in court. You can’t opt out. You can’t negotiate. You aren’t even told what they are.
If this were any other contract—a mortgage, a car loan, a medical consent form—it would be illegal to hide the terms. Yet this happens every day at every courthouse in America.
I don’t oppose marriage. I oppose signing a legally binding contract blindfolded. People deserve to know what they are agreeing to before they commit their lives and finances to another person under the state’s rules. That’s not cynicism—it’s informed consent and basic constitutional fairness.
This movement isn’t anti-marriage. It’s pro-transparency. It’s about trust, honesty, and accountability in the law. Every citizen should have the right to see—clearly and in plain language—the legal consequences of the commitments they make.
That’s why I’m calling on Congress and all 50 state legislatures to adopt a Marriage Terms Disclosure Act requiring every state to provide a full written explanation of the legal rights and obligations that marriage creates before issuing any marriage license.
No one should have to learn what they signed up for after it’s too late.
