Require Financial Institutions to allow Consumers to Add a Gratuity to Processing Payments
The Issue
The average American Household pays out about $185 per year in NSF Fees, or Not Sufficient Funds Fees. This is revenue generated by banks from the poorest of the poor. The bank is literally saying that "You're so broke that we have to extend you credit, and you have to pay us for that credit extension." While there are circumstances of money mismanagement, there are many people who might go out to dinner, leave a decent tip and because their bank tells them they've got $10 in their account still, throw a few bucks in the tank, and head home, only to find out come Tuesday morning they've gotten an overdraft fee.
Why? Because after dinner, they tipped their server $8 on their $40 meal. Therefore, the bank didn't have sufficient funds in their account to cover the gas they put in the tank of the car. The consumer put $9 in the tank, but really only had $2 in their account. Why would they do that? The bank told them they could with the available funds amount.
Why wouldn't the consumer realize that? Many people, the writer of this petition included, have the attention span of a goldfish. They forget. And they have no way to communicate to the bank the fact they tipped their server, and to put additional funds on hold.
Overall, this petition is designed to impact the $5.8 Billion line item for the banks and keep it in the hands of those impacted by the change, a very simple, technological requirement, for banks to add a button on transactions, for a person to press to "Add a Tip" or "Add a Gratuity" and communicate the amount of their tip to their financial institution. This would immediately come off the user's available balance and help them to avoid any NSF fees.
