Despite BYOG being deleted, recent documents obtained through a FOIL request seem to reveal troubling information regarding the handling of our children’s data and privacy.

See below correspondence:

9.29 Email from Board President stating there is a signed Data Privacy Agreement
10.9 Transcript from Superintendent Nagler at the BOE meeting stating there is a signed Data Privacy Agreement
10.23 District FOIL Response stating the Data Security and Privacy Plan WAS NEVER EXECUTED

Email from the Board on September 29th:

“As required by New York Education Law Section 2-d, Quave has completed the standard data privacy agreement required of all vendors in the district with whom student data is shared. A written agreement has been signed and will be formally approved at the next Board meeting. Quave is currently adhering, and will continue to adhere, to all of the protection requirements of student data outlined in federal and New York State law and regulation, and the district's policies regarding protection of student data and privacy.”

Transcript from Superintendent Nagler’s presentation at the October 9th Board Meeting:

“In terms of a data privacy agreement, PII, personally identifiable information, has always been protected. We collected two pieces of information — the name and the school email address. It was stored on a cloud server following standard protocols.” … “In terms of COPPA, HIPAA, and FERPA, none of those were violated. The Ed Law 2-D was followed and an agreement was signed.”

October 23rd – Response from Mineola’s Records Access Officer to my request for the executed Data Privacy Agreement:

“Additionally, there is an unexecuted data security and privacy plan between the Quave and the Board, which is responsive to your request for data protection agreements.” … “The data security and privacy plan was never executed because it was not approved by the Board of Education.”

These records seem to indicate that, despite public statements from both the Board President and Superintendent asserting that a signed agreement exists—as required under New York State law to safeguard student data—no such executed agreement was ever in place.
