Remove NSW requirement for trans* people to have surgery to change gender marker

The issue

This issue is far from abstract—a dear friend of mine, like many trans* people in New South Wales, Australia, strives for the respect, dignity, self- and personhood that should be their fundamental right. These individuals shouldn't have to endure invasive surgery, nor make the existence of such procedures public knowledge, in order to alter the gender markers on their birth certificates. This process invades their right to privacy and deeply personal choices about their own bodies.

There's an urgent need to revise this requirement. Currently, New South Wales is one of the last jurisdictions in Australia requiring trans* individuals to undergo surgery to update their birth certificate gender markers (source: Human Rights Law Centre). This not only threatens an individual's physical well-being, but also imposes a psychological burden by compelling them to make decisions that might not be in harmony with their authentic self-identity.

By allowing trans* people to update their birth certificates without surgical requirements, we foster an environment that recognises and respects each person's identity, fostering a more inclusive and compassionate society. Sign this petition now, to call on the New South Wales legislative assembly to amend the Births, Deaths and Marriages Registration Act 1995, thus breaking down one of the barriers trans* people face in securing their essential rights and dignity. Sign today and stand for human rights.
