The Issue

Florida lawmakers are advancing SB 164, a dangerous bill that threatens reproductive freedom, endangers patient privacy, and risks worsening the state’s already declining maternal healthcare system. We call on the Florida Senate to reject this bill in its entirety.

SB 164 would allow any person who impregnates someone to sue over an abortion or miscarriage—including abusive partners, ex-partners, and even rapists. There are no protections in the bill to prevent these individuals from weaponizing the courts to harass, intimidate, or financially punish their victims, as well as friends, family, or medical providers who help someone access care.

This bill isn’t about protecting grieving parents. Under current Florida law, people already have the ability to seek legal redress for the loss of a pregnancy due to accidents. SB 164 goes far beyond that—opening the door to frivolous lawsuits against doctors, hospitals, and anyone who supports a pregnant person in making private medical decisions.

The consequences will be far-reaching and dangerous. Doctors may delay or deny time-sensitive care for fear of being sued. Hospitals could turn away patients. And OB/GYNs—already leaving the state due to hostile legislation—may flee in even greater numbers, leaving many Floridians without access to prenatal and emergency reproductive care.

Rural and low-income communities will be hit the hardest. These areas already struggle with limited access to healthcare providers. SB 164 would make that crisis worse, turning Florida into one of the most hostile states in the country for maternal healthcare.

This bill does not protect life—it endangers it. It does not strengthen families—it puts them at risk. We urge Florida lawmakers to stand up for medical privacy, patient safety, and basic human dignity.

Reject SB 164. Protect reproductive freedom and maternal healthcare in Florida.
