Reinstate ASA Rita Wistoff-Ito as Lead Prosecutor in Murder of Timothy Reynolds
The Issue
We are petitioning the Baltimore City State's Attorney because a dedicated veteran homicide prosecutor in Baltimore was wrongfully removed from her position, and she must be reinstated in the interests of justice for our family and for many other families of murder victims too.
Our beloved Timothy Reynolds — a father, husband, brother, son, cousin, and friend — was senselessly gunned down on July 7, 2022. Assistant State’s Attorney Rita Wistoff-Ito served as the lead prosecutor in the case against the man who killed him.
Thanks to our advocates, the public now knows that, according to the State’s own evidence, the Defendant retrieved a bag with a gun before approaching Tim, that the Defendant then moved away to pull a ski mask over his face, and then followed Tim with two others as he was returning to his car, ultimately shooting Tim five times — multiple times in the back — while Tim was disoriented after being hit over the head by a brick or piece of concrete.
There is no one who knows this case better than Rita. She worked with the detectives throughout the investigation; she presented the indictment to the grand jury; she built strong relationships with the witnesses; and she has sought the truth and fought for us at every step.
The prosecution of this case is weaker without Rita. And the reason for removing her was just wrong.
State's Attorney Marilyn Mosby told the court that Rita was removed because she shared with the victims' lawyer a copy of a document she had just filed with the court. But, under Maryland law, Rita was required to provide us this copy.
Maryland Rule 1-326(b) explicitly states: 'A party shall serve on the attorney for a victim or a victim's representative, copies of all pleadings or papers that relate to:
(1) the right of the victim or victim's representative to be informed regarding the criminal or juvenile delinquency case, [or]
(2) the right of the victim or victim's representative to be present and heard at any hearing…'
So Marilyn Mosby removed Rita for doing something she was required by law to do. This is a mistake Ms. Mosby can correct. We hope she will have the courage and integrity to do so.
Rita deserves to be back in the homicide division where she was one of the very few seasoned prosecutors remaining. Our family deserves that; other families in her other cases deserve that; and most importantly Rita, who has devoted her career to being a prosecutor, deserves that.
