Reform medical negligence claim timelines

The Issue

Fourteen years ago, I gave birth and my life changed forever. Instead of the joyous occasion I had envisioned, the aftermath has been a relentless journey through ongoing medical problems. Since childbirth, I've experienced persistent vaginal and perineal issues; issues that have significantly impacted my quality of life. Yet, despite living with these unresolved conditions for over a decade, the legal system's strict timelines threaten to deny my right to seek justice for what I've endured.

The current statutory limits for filing medical negligence claims can unjustly hinder patients like me, who have long-term or progressively worsening symptoms, from pursuing legal recourse. In cases of chronic conditions, it's not uncommon for symptoms to persist or even become apparent only after significant time has passed since the affected medical treatment. Moreover, care can often be delayed for various reasons beyond a patient's control, exacerbating the issue. Under the present system, these factors are not adequately considered, leaving many without the ability to challenge and rectify the care they received.

According to a report from the Medical Negligence Society, more than 20% of medical negligence cases are struck down annually due to exceeded deadlines, irrespective of the compelling evidence about patient suffering. This statistic highlights the systemic flaw that fails to accommodate the complexities of many medical issues. The law must evolve to mirror the realities patients face, offering flexibility for those with chronic conditions.

I am calling for a reform in the legal system governing medical negligence claim deadlines to adequately reflect the ongoing and protracted nature of many medical conditions. Implementing exceptions for cases demonstrating prolonged impact and introducing a more reasonable timeframe in which such claims can be lodged will bring us closer to a just system.
