Reform Juvenile Bail System and Improve Plea Bargain Fairness

The Issue

Working with youth for over a decade has unveiled a disheartening reality. Economically disadvantaged young individuals often languish in pretrial detention, causing them to develop increased hostility and a likelihood to reoffend while in custody. The need for bail system reform is palpable and urgent for these juveniles and young adults.

Particularly for those reliant on court-appointed attorneys who grapple with financial hardship, the system does not offer fair plea bargains comparable to those their co-conspirators receive. This disproportionate representation of justice is a sad testament to the inequality that persists in our criminal justice system.

According to the National Juvenile Defender Center, the U.S bail system disproportionately affects low-income defendants and their families, and is a significant contributing factor to racial and economic disparities in the juvenile justice system. The use of cash bail and financial conditions for release often results in poorer youth remaining incarcerated pretrial, simply because their families cannot afford bail.

We need to stand up against these unjust practices and demand reform in the Juvenile Bail System. It is incumbent upon us to ensure that all young people, regardless of their financial standing, have equal access to justice, fair plea deals, and the promise of a brighter future.
