The Issue
Fair and Transparent Judiciary in Bharat: A Call to Action

We, the concerned citizens of Bharat, urge you to ensure a fair and transparent judiciary in our country. The judiciary is the cornerstone of democracy, and it is essential that it remains impartial, accountable, and transparent.
Judiciary in its current vestigial colonial form is completely partial, opaque and unreliable to a large extent. In the current setup the judiciary can easily be 'convinced' to convict Lord Ram as a murderer of Ravan. In this leftover colonial state magistrates confuse themselves to be the embodied Court, Lords, Majesties and so on, with no sense of their responsibility towards social well-being and might of the "just".
Moreso, retail justice is totally out of bounds in the wholesale market. It is only the mighty or the wealthy who seem to be the ones reaping results from the judicial procedures. For common citizens it is still sin to step into the court Raj or the police Raj. Such unfair procedures evidently lack results for the common citizens who are unexposed to the systems fuelling babudom. Court babus and magistrates are in a position to enter anything on records as per their entwined convenient interests and can thus lead a case to their desired outcome. Such possibilities can easily be considered as the main source of their allowances.
Key Demands:
Equal and Impartial Judiciary:
- Ensure that the judiciary remains equal, impartial, free from any external influences or biases, and relevant to national interests.
Transparency in Judicial Appointments:
- Make the process of judicial appointments transparent, merit-based, and answerable to citizens.
Accountability Mechanisms:
- Establish foolproof accountability mechanisms to ensure that delivery of justice becomes a fair, transparent process that protects the just and the principled.
- All court proceedings should be monitored round the clock through functional audio-visual equipment and their recordings be preserved in support to all documentation. Absence of such recordings should be a punishable offence comparable to tampering with court records.
- Implement one easily accessible redressal mechanism to address complaints of judicial misconduct or incompetence. Bring in a procedure to ensure the guilty in such a cases necessarily meet exemplary consequences, while ensuring robust safeguards for the whistleblower.
Access to Justice:
- Ensure that all citizens have access to justice, regardless of their socio-economic background or geographical location.
Why is this Important?
In the Mahabharat it is stated that guardianship and wellbeing of its citizens is the primary responsibility of State (monarch in that context). Without a reliable judiciary and police force this responsibility of the State cannot be fulfilled.
A fair and transparent judiciary is essential for upholding the rule of law, protecting equality, and promoting social justice. It is crucial that we demand accountability and transparency from our judiciary to ensure that it remains a beacon of hope for the just and law abiding citizens of our society.
