Reform Domestic Violence Laws to Ensure Fair Police Response
The Issue
I am a victim, not of physical violence, but of a system that failed me. I discovered my partner's infidelity multiple times and when I finally decided to end the relationship for the sake of our child and my own sanity, she retaliated by falsely accusing me of abuse. Despite the charges being dismissed later on, I was unjustly incarcerated (twice) and spent time in jail (both times) while she took our daughter away and pillaged my house during my time in police custody.
This is not an isolated incident. Many individuals across our nation face similar situations due to current domestic violence laws that often result in immediate arrest without thorough investigation. According to a study by Harvard Law School, false allegations are used as a weapon in family disputes with alarming frequency (Harvard Law Review, 2017). This leads to innocent people being incarcerated and families torn apart based on unverified claims.
We need reform now more than ever. We need laws that ensure police conduct thorough investigations before making arrests in domestic disputes. We must protect victims of actual abuse (inclusive of all genders and sexual orientations) while also safeguarding against false accusations that can ruin lives.
