The Issue
This petition originates from a profound personal ordeal. I sought to modify custody for my 15-year-old child who was subjected to physical abuse in their mother's home by her live-in boyfriend. Despite presenting tangible evidence, the court ruled against me due to what I believe was an underhanded scheme. This experience illuminates a systemic issue – the discretionary power of family court judges in Onondaga County and elsewhere, which can lead to reported violations of the due process clause in these judicial proceedings.
There have been prior allegations of inappropriate behavior, yet these judges seemingly persist without repercussions. This affects not only my family but countless others. It is worth noting that as per the U.S courts, deprivations of parental rights are subject to strict scrutiny and may strictly require a compelling state interest (Moss, Eleonore. Yale Law Journal, 2016).
Furthermore, the current system permits possible biases due to a person’s criminal history or sex, exacerbating the erosion of parental rights. This is clearly not in alignment with the essence of judicial proceedings, which ought to uphold fairness and impartiality.
The potential for misuse of judicial discretion is a genuine concern, spiraling into a broader federal question - are we allowing a violation of parental rights based on predisposed biases? It is high time we appealed for a change in the way family court judges exercise their discretion.
The goal of this petition is to urge lawmakers, judicial institutions, and relevant authorities to implement necessary reforms to secure the fundamental rights of parents in Onondaga County, and indeed across the country.
