Reform birth & child negligence compensation processes in UK
The Issue
Hours after the birth of my first child, he was presenting with an uncontrollable fever and concerns were raised. We were inpatients following pregnancy difficulties and were staying on the high dependency ward and were supposed to be regularly monitored. After a slow response and failed attempts to reduce his temperature, I was ordered to take him to be checked by a paediatric doctor in the intensive care unit. This was first thing in the morning and as soon he staff would be handing over and wanting to go home. Procedures were not followed and my son was with permanent injuries due to medical negligence. In what was supposed to be the most joyous moment of my life., I was instead thrown into a battle i never anticipated—a battle for justice, for acknowledgment, and for compensation the future of my child.
Sadly, our story is not unique. Across the UK, countless families find themselves navigating a legal and medical system that seems stacked against them when it comes to seeking compensation for birth negligence.
The process of obtaining fair compensation for child and birth negligence is fraught with challenges. Parents and families who instead want to focus on healing and supporting their children are left fighting daunting legal battles. The current framework overseen by courts and handled by law firms often lack transparency, compassion, and efficiency. Families deserve to be treated with dignity and respect. They deserve a system that doesn't exacerbate their pain, and supports them to receive the compensation the family and child deserve rather than the cases being purely for profit of legal firms and corporations.
Statistics continue to reveal alarming trends. According to a recent government report, birth-related negligence cases have increased by 15% over the last five years, yet the time it takes to reach settlements has doubled. Families end up spending years tangled in red tape, facing mounting legal costs and emotional stress, often with little reward or closure. This is unacceptable.
We propose a multi-tier reform to address these issues:
1.Complete Family involvement pre and post settlement: families are dragged through the process for years and promised support to them, complete involvement with decision making, litigation and deputies who then post settlement once the child becomes an adult, make it their mission to remove all family involvement. Care, living arrangements, decisions, support for their now young person and extradite them
2. Transparency: Establish clear guidelines for how birth negligence cases are to be managed, ensuring both courts and law firms operate under a unified standard that prioritises swift justice.
3: Efficiency: Implement a fast-track system for cases involving severe, life-altering injuries to children, reducing the legal process from years to months.
4. Support System: Mandate psychological and emotional support services for affected families, funded by the state, to assist them through the legal process.
5.Education and Training; Increase training for medical staff to prevent negligence, supported by a revised reporting system to catch and address issues early.
By signing this petition, you are standing with families who have suffered far too long without the support or justice they deserve. Let us urge the UK legal system to reform its handling of child and birth negligence cases, ensuring every child receives the fairness and future they are entitled to. Please sign this petition and help us bring about this much-needed change.
