The Issue

I am facing an incredibly distressing situation. My partner, who is American, and I wish to get married, but currently, India does not recognize same-sex marriages. This lack of recognition creates an endless loop of visa runs, where my partner must leave the country every six months. Each time, I am compelled to travel just to see him again. My personal challenge is compounded by my family circumstances. I have an elderly mother, 65, who is battling multiple health issues, including a previous bout with breast cancer, diabetes, and chronic kidney disease. Leaving her alone, especially when she needs me the most, feels heartbreaking.

The restrictions on same-sex marriage are not only affecting my personal life but countless other couples in India who find themselves divided by the barriers to legal recognition of their love. Love knows no boundaries, and marriages should not be constrained by outdated legal frameworks that fail to encompass the realities of modern relationships.

More than 30 countries worldwide have implemented marriage equality, including the recognition of same-sex unions. According to the Pew Research Center, societal acceptance of same-sex relationships has grown steadily around the world. It is high time that India joins the ranks of progressive nations recognizing the rights of all couples to marry the person they love, regardless of their sexual orientation.

By recognizing same-sex marriages, India would not only affirm the principles of equality and non-discrimination enshrined in its Constitution, but would also ensure that international spouses in such marriages receive equal rights to citizenship, residency, and visa benefits. This change would alleviate the burden on countless families, ensuring they can be together, share their lives, and support one another in challenging times.
