Subject: Urgent representation by the brother-in-law of the deceased seeking immediate reinvestigation of Cr. No. 33/2026 of Nandipet Police Station, Nizamabad District, re-recording of the supplementary statement of the husband Sri Devidas Waghmare, addition of sections for gang-rape and murder under Bharatiya Nyaya Sanhita (BNS) and SC/ST (Prevention of Atrocities) Act, 1989, and arrest of the accused in the brutal gang-rape and murder of Scheduled Caste woman Smt. Rekha Waghmare – Reg.

 

Respected Sirs,

1.     I, S. Sanjeev, brother-in-law of the deceased Smt. Rekha Waghmare, am filing this representation on my own behalf and on behalf of the victim’s family. I have already pursued this case vigorously by filing

detailed complaints before the Commissioner of Police, Nizamabad on 24-02-2026 and before the District Collector & Magistrate, Nizamabad on 02-03-2026

2.     I submit that despite specific allegations of gang-rape and murder, the local police have failed to conduct a fair investigation.

 

3.     I submit that My sister-in-law, Smt. Rekha Waghmare (aged about 32 years), belonging to the Scheduled Caste (Mala) community and a migrant labourer from Maharashtra, was found dead in highly

suspicious circumstances on 13-02-2026 in Donkeshwar Village, Nandipet Mandal, Nizamabad District.

 

4.     I submit that the Nandipet Police registered FIR No. 33/2026 only under Section 108 BNS (abetment of suicide) against her husband Sri Devidas Waghmare, completely ignoring the real culprits.

 

5.     The Postmortem Findings (PM No. 103/2026 dated 14.02.2026, Government Medical College, Nizamabad) – Strong Evidence of Homicidal Assault & Staged Suicide:

 

6.     The postmortem report and FSL reports reveal glaring discrepancies with the “suicide” theory: Cause of death: Asphyxia consequent to hanging.

 

7.     Antemortem head injury: Contusion 8×4 cm over the left parietotemporal region of the scalp with underlying subdural haemorrhage on the left frontotemporal region of the brain – a significant blunt-force trauma completely unexplained in the FIR.

 

8.     The Ligature mark: Antemortem ligature mark (pressure abrasion) 25×2-3 cm, oblique, above thyroid cartilage. On dissection, “subcutaneous tissue under the ligature mark is whitened, hardened and glistening without extravasation of blood in and around.” Hyoid bone and thyroid cartilage intact. This absence of vital reaction strongly suggests the ligature was applied when the victim was already unconscious or possibly postmortem, indicating homicidal hanging staged as suicide.

9.      I submit that the other injuries: Abrasions on the back of left arm and right elbow (possibly defensive). No semen/spermatozoa in vaginal/anal swabs; no poison in viscera.

 

10.  I submit that these scientific findings prove homicidal assault followed by staging of suicide and directly contradict the FIR version.

 

11.  I submit that the husband of Rekha Waghmare, Sri Devidas Waghmare has consistently stated that his wife was raped and killed by Barla Narsingh Reddy and Vithal Emphalwar. The FIR records a fabricated version suppressing this. Further, the husband was again detained in the police station on 23/04/2026 solely to pressure him into giving a favourable statement in favour of the accused. Despite repeated requests, the Investigating Officer has refused to re-record his supplementary statement under Section 161 CrPC.4.

 

12.  I submit that as detailed in my earlier complaints dated 24-02-2026 and 02-03-2026, the landlord Barla Narsing Reddy and his associate Vittal Empalwad intentionally sent the husband away, gang-raped my sister-in-law Rekha, and murdered her.

 

13.  The Local police personnel (Constables Shabir and Vijay) colluded with a local influential person (Bharat Reddy) and hurriedly removed the body before formal inquest. Taking advantage of the fact that our family are non-locals and not well-versed in Telugu, a fabricated statement was recorded.

 

14.  I submit that the police have deliberately shielded the influential accused and this is a gross violation of Articles 14, 15, 21 and 39 of the Constitution of India and the rights of a vulnerable Dalit woman and her two minor children.

 

15.  In view of the above, I most respectfully request you to kindly:

 

a.     Immediately direct reinvestigation of Cr. No. 33/2026 and re-record the supplementary statement of the husband Sri Devidas Waghmare under Section 161 CrPC, taking into account the postmortem findings and the illegal detention on 23/04/2026.

b.     Alter/add appropriate sections in the FIR, including: Gang-rape and murder under Bharatiya Nyaya Sanhita (BNS Sections 63, 64, 65, 66, 103 etc.); Relevant provisions of the SC/ST (Prevention of Atrocities) Act, 1989 (including Sections 3(1)(w), 3(2)(v) etc.).

c.     Order the immediate arrest of the prime accused Barla Narsing Reddy and Vittal Empalwad.

 

d.    Constitute a Special Investigation Team (SIT) headed by a senior IPS officer or transfer the case to CID for a fair and time-bound

investigation.

 

e.    Initiate departmental and criminal proceedings against the erring police officials of Nandipet Police Station (including Constables Shabir and Vijay and the concerned Sub-Inspector).

 

f.      Ensure protection and support to the two minor children and the family of the deceased.
