When the case filed by the Royal College Union (RCU) was taken up for support today in the Court of Appeal, before Justice Arjuna Obeysekera, pursuant to the last days proceedings, the matter was agreed to be settled by Mr.Sanjeeva Jayawardena PC appearing for the RCU and Mr Sanjay Rajaratnam PC appearing for the respondents, upon the following express terms of settlement :

1. The 14th respondent, Mr.Kusala Fernando will not be appointed as acting principal of Royal College, Colombo 7.

2. No further appointments to the post of Principal of Royal College, Colombo 7, shall be made, until a fresh evaluation criteria is completed by the Public Service Commission and the Ministry of Education , and duly published.

3. The Status Quo prevailing as at today with regard to the post of Principal of Royal College,, shall continue until the scheme is formulated and selection is made thereafter.

4. The public service commission has cancelled the selection processes for the selection and appointment of principals to national schools.

The Hon. Court of Appeal recorded these terms of settlement and undertakings.

Mr.Sanjeeva Jayawardena PC informed court that in view of the settlement that was entered, that it was not required to proceed with the case any further and that proceedings could be terminated.

Hon.Justice Arjuna Obeysekera entered the terms and accordingly made order terminating proceedings.

The counsel in the connected cases including Messrs K.Kanag-Isvaran PC, Gamini Marapone PC, Faisz Musthapha PC, Romesh de Silva PC, Nihal Jayamanne PC, Nihal Fernando PC, Uditha Egalahewa PC, Harsha Amarasekera PC, Kushan D’Alwis PC, Kuvera De Soyza PC and Dr.Asanga Gunawansa agreed that the settlement entered in the Royal College Union case could bind all those other cases as well.
