The PUSH FOR 5 coalition is to fight to make Illinois become the fifth state to END QUALIFIED IMMUNITY like Colorado, Montana, Nevada, and New Mexico.

What’s at stake since President Elect Donald Trump will become the 47th President of the United States of America?

 

Now that the election is final and President Elect Donald Trump will be President for the next 4 years, the George Floyd Policing Act is in jeopardy.  

 

·         President-Elect Donald Trump is in the White House

·         Republicans have the majority in the Senate 

·         Republicans are on their way have the majority in the House

·         Supreme Court Judges and Federal Judges will be selected that is alignment to protect Law Enforcement in ABSOLUTE IMMUNITY.

 

As a result, The George Floyd Policing Act will NEVER become law when President-Elect Trump who emphatically wants to shield  law enforcement with complete immunity.  An article publication by Reason offers a direct quote that was said publicly by President-Elect Trump 

 

Reason reports, “One such promise: "We're going to give our police their power back," he told rallygoers in Waukesha, "and we are going to give them immunity from prosecution." Between police and prosecutors, law enforcement officers are arguably already the most powerful people in government, so it's unclear what Trump means by giving them "their power back." His second promise, though—immunity from prosecution—is more concrete, and a reminder of the former president's views on government accountability, (2024, Binion).

 

Why should Illinois END QUALIFIED IMMUNITY?

 

Law enforcement in Illinois continues to violate the Fourth Amendment which prohibits unreasonable searches, seizures, racial profiling, foot chase, reckless excessive force and more.

 

In addition, the Fourth Amendment guarantees civil protections to every citizen of the United States. Even with these civil protections in place for all citizens of the United States, Law Enforcement across the country resort to excessive force including but not limited to: Chock holds, Foot Chasing that leads to murder, physical beatings,  knees on the neck and back, use of a deadly weapon and more.

What does statistics say how severe Police Brutality is Illinois?

 

Chicago Tribune reports, “Between 74 and 140 people have died due to their interactions with police since 2016 in Illinois alone, according to data collected as part of the University of Illinois Chicago’s law enforcement epidemiology project. African Americans, homeless people, those with motor disabilities and individuals with psychiatric conditions are more likely to be injured, suffer severe injuries and be killed during contact with law enforcement, the report found.” (Stevens, 2024).

 

A Better Government says, "Still, in 113 police shootings in the Cook County suburbs since 2005, records show not a single case led to disciplinary action for an officer who made a mistake. Not one lost their job. Not one criminal case was filed against an officer.” (2018, Toner, Rutecki).  

 

Stanford Law School of its Stanford Center for Racial Justice released and study in focusing on the cases of Adam Toledo and Anthony Alvarez pertaing to the “Dangers of Foot Pursuit” that leads to murder. Even before these murders, Michael Westly, Darius Pinex, Rekia Boyd, Harith Augustus, Dakota Bright, Ronald Johnson, LaQuan McDonald, Reginald Clay Jr. Freddie Latrice Wilson and more were murdered by Law Enforcement after the results of a Foot Chase within the State of Illinois.
 

As a result, the Adam Toledo and Anthony Alvarez cases prompted this study released as follows. According to Stanford Center for Racial Justice says, 
“For instance, over an eight-year period in Chicago, half of all police shootings occurred immediately after or in conjunction with foot pursuits, (2022, Rodriguez). 
 

Which states passed legislation to END QUALIFIED IMMUNITY?

 

As of today, four states such as Colorado, Montana, Nevada, and New Mexico—have eliminated qualified immunity for state constitutional lawsuits against police officers.

 

As a result, Chicago Activist Coalition For Justice has launched effective immediately this campaign in Illinois that is called “Push for 5”.

 

 

What are the demands for “Push for 5”?

 

“Push For 5” is a new campaign to advocate that Illinois passes legislation to be the 5th State to END QUALIFIED IMMUNITY. 

 

DEMANDS:

 

1.      End Qualified Immunity

 

2.      Prohibit Illinois citizens responsible for Law Enforcement Liability Insurance w/Misconduct history

 

3.      Decertification Police Officers with/Misconduct Record must enter a tracking system to prevent rehired at another police department.

 

4.      ALL Law Enforcement must work under a license issued by the State of Illinois. Any substantiated misconduct can be grounds of issued license by the state of Illinois can be revoked.

 

5.      Terminate law enforcement members of extremist organizations in Illinois

 

How does the bill for END QUALIFIED IMMUNITY address cases pertaining to Civil Lawsuits and Criminal Prosecution?

 

In some states where End Qualified Immunity applies, only covers in civil lawsuits, and not criminal prosecutions.  In this bill introduced in Illinois, Qualified Immunity will apply to both civil lawsuits and criminal prosecution.

 

Who is liable for Legal action under END QUALIFIED IMMUNITY?

 

 This includes, for example, law enforcement mayors, governors,  prison faculty,  ankle-monitoring companies, IRS agents, and everyone else who works for the government, as well as private individuals who act jointly with government workers or undertake governmental tasks, such as private prison operators and ankle-monitoring companies.
