Replace Festival Foothills HOA management company AAM

The Issue

Our HOA board has hired AAM to care and maintain our community. Offenses committed by AAM can not be overlooked any longer. AAM is required to maintain a Standard of Care outlined in our CC&R's Article 10.1.3 stating "...the Association assumes responsibility so that the covered property will reflect a high degree of pride and ownership." AAM is so quick to write fee's to us as homeowners, yet neglects the amenities/common areas we all pay for.

Residents have found and reported neglect in many areas including: our community budget, community amenities, landscape care, pest control, and responsive management communication.

Over the years Festival Foothills has been in a steady state of deterioration. This decline has spanned many areas of the community, to name a few: failure to replace removed trees and playground equipment, unsafe play spaces for our children, and improper landscape maintenance. A valued asset we have here is our big community park and splash pad. This major amenity is in shambles. Why has it taken years to only have SOME of the issues in this area finally addressed, in this most recent liaison meeting?

Splash Pad

*The deterioration of the flooring in our splash pad has been ongoing and reported since 2019. AAM has responded that they will "look into", "Start getting bids for replacements", "cannot replace until October 2021 because of the weather".  According to the reserve study done in 2014, the flooring was placed in 2008, had a 10 year life span and was due to be replaced in 2018. However, in the reserve study in 2018 it was grouped into splash pad components and given a 20 year life span. Our community manager Liz Paz has advised me the flooring was replaced in March of 2016, but has not provided the invoice/receipt of work done. 

Big Community Park

*Our community park is also in deplorable condition. A slide has been boarded off since April 2021 and the protective coating on the flooring is melting off. AAM has stated a slide has been ordered and on back order due to be replaced August 2021. However, again our community manager will not provide proof of purchase for the slide and no response given to the flooring that is now exposing hot metal. Several requests have gone unanswered for review of our contract for our parks as well as the quarterly reports for the playground.

Landscaping and Pest Control

Along with these main issues are numerous issues with landscaping and pests. The condition of Festival Foothills did not happen overnight. This has been several years of no proactive maintenance/replacement by our HOA management company AAM. During the community liaison’s quarterly meeting in July, our Community Manager has admitted that she has not surveyed our community but relied on inspection reports from our venders. 

AAM is contracted by Pulte to manage our community. Our HOA is currently not homeowner ran. During the building process our board members are comprised of Pulte representatives. We only have one annual meeting to voice our concerns. With our community being in the last phase and 100% build out in our sights, talk began of replacing Pulte board members with actual homeowners. Since the last meeting in July, Pulte has expressed that they will be adding family housing adjacent to the senior community. Putting the homeowners unable to take control of our HOA with no end in sight. 

With no homeowner representation, Pulte is the governing board to make this decision to drop AAM as their management provider. If they do not, we will continue to see further decline in our community, no safe place for our children to play, and continue to pay some of the highest HOA fee's in our city for very minimal amenities available to us. There is no transparency from AAM or accountability for the mismanagement of Festival Foothills.
