Highlights of Dr. Sayer's presentation include, but are not limited to: 5:10 What is Regulation? Its the arbitration between private and public interests, with the public interest in sport being fairness. 9:10 Regulators and the conflict of interest they create 10:00 Future WADA 2017 code will include statements on proportionality and human rights 11:30 Anti Doping Regulation components generate a pyramid of conflicts 19:00 WADA treats athletes/countries differently. They have a limited budget and they are riddled with conflicts. WADA must target to maintain attention. 21:30 WADA issues a puzzling response to an ASADA inquiry about Thymomodulin, as known as Thymosin. 24:50 WADA Code has changed 2,269 times over last 6 years; there were 50 different working drafts to be considered. 25:20 It is not mathematically possible for ASADA/WADA to test for everything. 26:40 A new approach to Anti Doping? 28:20 Athletes and the presumption of Innocence 31:00 WADA reverses the onus of proof in order to target athletes 32:00 The probability factor of comfortable satisfaction against the 34 Essendon case is, in fact, less than 20% 34:10 WADA targeting athletes is a risk to all athletes 35:00 There were red flags in the investigation against the 34 Essendon players. Both AFL (the governing body) and Essendon should have been investigated 38:00 First reason why Dank used Thymomodulin, the good Thymosin; It was discovered he used it at Melbourne Football Club and this was confirmed by ABC's 7:30 report. 40:00 Comparison of the Essendon FC -v- Melbourne FC supplement program; it was the same program 40:40 ASADA accepted Dank used Thymomodulin and AOD9604 at Melbourne FC, but not at Essendon FC. 42:40 The only question ASADA should have answered: Did Dank use Thymomodulin on both programs? If not, why would Dank switch from Thymosin Beta 4 at Essendon FC to Thymomodulin at Melbourne FC? He wouldn’t switch. 43:50 Who was the person ASADA/WADA/CAS should have listened too? 46:20: The second reason why Dank used Thymomodulin: On July 3, during the investigation, ASADA emailed WADA and enquired about Thymomodulin 47:20 The third reason why Dank used Thymomodulin; Mitigating text messages from the Melbourne FC supplement program were never produced during the Essendon FC prosecution. 48:50 The Fourth reason why Dank used Thymomodulin. People are habitual and so is Dank. The program was working, so why would one change it. Therefore Dank most likely used Thymomodulin at both Essendon and Melbourne FCs 49:50 Summary; Both clubs supplement program were undertaken in the same year, one club is penalised three times, the other club was exonerated. 51:10 The need for a Senate Inquiry. The Justice for the 34 Group will be releasing a series of videos, documents and evidence (in ‘exhibit’ form) which they believe will uncover what actually happened during the 2012 Essendon Football Club's supplement program.
