I’ve said this before but it’s worth repeating. Every medical negligence lawsuit against a Doctor in Canada is defended by the Canadian Medical Protective Association (CMPA). The CMPA is not an insurance company. It is an association of thousands of Doctors. It is funded by annual fees contributed and much larger amounts provided by provincial governments. 

In 2021 the CMPA reserved 91 ,000 ,000 to fight lawsuits against its member doctors and to pay damages awarded against doctors. The CMPA vigorously fights every lawsuit over several years. The legal fees pile up over these several years. There’s  a cap on how much a Doctor can be sued for in Canada. Because of this cap often the victim’s end up with very little to nothing after legal costs are paid even if they win. 

On top of this there’s a two year statute of limitations. If you need a lawyer for a medical malpractice lawsuit it’s obviously because of harm or death. The most vulnerable people are expected to get it together quickly  and fight like Olympic athletes when their minds and bodies have been severely compromised. I feel it’s an extremely unfair system that leads to no accountability. 

PREVENTION so that people do not have to enter these complex systems is the way to go. Get mandatory laws in place to prevent the harm before it’s done. Madi’s Law is a common sense approach towards this. Please continue to share.
