Local 501(c)(3) non-profit Save Belmar Park, Inc. has announced their intention to file a Colorado Rules of Civil Procedure Rule 106 legal challenge to the proposed 411-unit apartment building on the edge of Belmar Park in Lakewood, Colorado. Their decision is in response to the Lakewood Planning Commission giving approval to the project at a quasi-judicial public hearing on May 7, 2025.
The commission heard testimony from various experts including biologist Dr. Michael Pardo who also created this outstanding presentation for them.
The tax-deductible non-profit had previously retained an attorney for this purpose due to the expectation that the commission would approve the project despite compelling expert testimony including many alleged violations of Lakewood's Comprehensive Plan and Zoning Code raised by experts and others.
Now that the commission has rendered their decision, no matter how ill-considered, that opens the door to the Rule 106 challenge which must be filed in the next several weeks.
