On 13th December 2023, the European Parliament, the Spanish Presidency of the Council of EU Member States and the European Commission reached an agreement on the proposed Platform Work Directive (PWD) that could turn freelancers into employees.

According to the co-legislators public statements, employment status for the individual will be presumed if two out of five arbitrary indicators of the mechanism put in place are met.

That puts hundreds of thousands of freelancers and platform workers at risk of reclassification regardless of their wishes, while making the process very unclear.

This agreement is the result of negotiations behind closed doors, that saw a departure from the more balanced directions EU member states have given. The agreement needs to be formally endorsed by EU countries at a meeting of EU Ambassadors, due to take place on Friday 22nd December. If enough EU countries vote against, the deal would be rejected and EU legislators would have to continue to negotiate to find a more balanced solution.
