It may have been a while between updates but that doesn't mean we haven't been working hard in the background. Late last year we wrote to the Department of Climate Change, Energy, the Environment and Water notifying that the Proponent has failed to self-refer under the Environment Protection and Biodiversity Conservation (EPBC) Act.
According to page 16 of Appendix Z submitted by the Proponent, it states in regards to approvals required;
Environment Protection and Biodiversity Conservation Act 1999 – Not required.
Contrary to this and as per page 44 of Appendix Z submitted by the Proponent, the report states that;
4.2. Threatened species assessment
4.2.1. Matters of National Environmental Significance
The EPBC Act PMST report identified 37 threatened species and 13 migratory species protected under the EPBC Act, which may be relevant to the Project Area.
We wrote to the Hon. Tanya Plibersek formally seeking her Department consider requesting referral of the proposal given the information that had been supplied by the Proponent.
We have since received Ministerial Correspondence stating that;
'The department has written to the proponent of the Mount Lofty Golf Estate regarding the proposal to ensure they are aware of their obligations under national environmental law.'
