Protect Stakeholder Rights: Stop CCI from Undermining the Judicial System

The Issue

We urge the Competition Commission of India (CCI) to respect and uphold the integrity of the judicial process and ensure that its actions do not undermine the independence of state high courts. Recent actions by the CCI, such as attempting to bypass ongoing legal proceedings in the Karnataka High Court, have raised serious concerns about procedural fairness and transparency. One such example is the case involving Walmart’s Flipkart and Amazon, where the CCI sought to transfer the case directly to the Supreme Court, disregarding the high court’s active involvement. This undermines the authority of the judiciary and risks creating a dangerous precedent of arbitrarily bypassing state courts. The remit of the CCI is to ensure fair competition and prevent anti-competitive behavior that could harm customers. However, the current approach risks detracting from this objective. The actions of the CCI must align with its mandate to prevent monopolistic practices, promote customer welfare, and avoid any perception of overreach or procedural unfairness.

Such actions threaten the trust placed in the judicial system by stakeholders, businesses, and investors.
