(a) Any person age eighteen or over who knowingly and intentionally produces, possesses, displays or distributes, in any form, any visual portrayals of minors who are partially clothed, where the visual portrayals are: (1) Unrelated to the sale of a commercially available legal product; and (2) used for purely prurient purposes, is guilty of a misdemeanor and, upon conviction thereof, shall be confined in jail for not more than one year or fined not more than $1,000, or both confined and fined.

This is the wv state code for child erotica a misdemeanor in our state, while a felony in several others. Recently a male was caught taking photos underwater of children up close and personal to their private part area's and the only code for what he did in wv is a misdemeanor offense.

He has been caught several times before, once resulting in 4 felonies in another state that were later dismissed. He has chosen time and time again to continue this behavior because he knows nothing can be done about it. How much longer do we sit by and let our children not be protected by the people we elect and pay taxes too. It's time to take a stand against the injustice against our children.

I'm really scared for my daughter to go out in public after what happened at the pool. The incident has left me feeling anxious and worried about her safety. It's hard to shake off the fear that something similar could happen again. I want to protect her and keep her safe, but I also know that she needs to experience life and enjoy her childhood. It's a constant battle between wanting to shield her from harm and allowing her the freedom to grow and explore.

We are asking that you sign this petition to make prohibiting child erotica a felony. Or enhance the charge to greater fines and jail time or make it to where if found guilty, the convicted must register as a sex offender.


No child should have to face the terror and trauma of someone praying on their innocence for sexual gratification or imagery of a child used in a sexual manner. Enough is enough.
