I am calling on the U.S. Congress to pass legislation that:

Excludes military BAH (Basic Allowance for Housing) and BAS (Basic Allowance for Subsistence) from state child support income calculations, and limits a parent from receiving child support if they are found to have committed adultery during the relationship.

Military allowances like BAH and BAS are not income they are non-taxable entitlements provided to support service members while serving our country. Including them as “income” in child support cases inflates obligations unfairly and places an unnecessary burden on those already giving so much.

Even worse, many courts allow parents who have cheated and broken trust in their relationship to still collect child support with no accountability. This goes against basic principles of justice and family integrity.

Why This Matters:

Military members already sacrifice time, family stability, and financial comfort in service to the nation.
BAH and BAS are entitlements, not wages they should not be used to inflate support payments.
Adultery destroys family units, and proven infidelity should factor into support and custody decisions.
Our current system rewards bad behavior while punishing responsible co-parents.

What We’re Asking:

We urge Congress to pass a law that:

Prohibits states from including BAH and BAS in military child support calculations
Bars or limits child support eligibility for any parent proven—through legal means—to have committed adultery.
