Protect Housing Society Funds: Remove Disqualified Auditors & Stop High Court Order Non-Co
The Issue
To
The Commissioner for Co-operation & Registrar of Co-operative Societies, Maharashtra State
The Additional Chief Secretary (Co-operation), Government of Maharashtra
PETITION STORY / BODY:
Every year, millions of housing society members across Maharashtra pay hard-earned money toward building maintenance and statutory audits. We rely on the State Co-operation Department’s official panel to provide tested, verified, and unblemished auditors to protect our life savings from financial fraud.
However, administrative oversight is placing our public funds at risk!
The Issue:
On 16th October 2026, the Hon’ble Bombay High Court (Writ Petition No. 5911 of 2026) upheld the de-panelment of a statutory auditor (CA Eknath Sonavale, Panel No. 15567) who was removed due to severe misconduct. The High Court explicitly ruled:
"He is free to perform his role as an auditor otherwise than on the panel of the cooperative Registrar."
Despite this crystal-clear judicial prohibition, his name continues to reflect on the official Panel of Statutory Auditors (2026–2028) under Entry No. 13466!
Allowing a judicially restricted auditor to remain on the official panel:
Flouts Judicial Mandates: Disregards the specific words of the Hon’ble Bombay High Court order.
Endangers Housing Societies: Exposes housing societies and citizens to unchecked malpractices, falsification of accounts, and financial risk.
Breaches Public Trust: Undermines citizens' faith in the statutory audit system.
WHAT WE ARE DEMANDING:
We, the residents, flat owners, and housing society members of Maharashtra, urge the Commissioner for Co-operation and the Government of Maharashtra to immediately:
Remove Disqualified Auditor Immediately: Issue an official rectificatory notification striking off Entry No. 13466 (Mr. Eknath Sonavale, Panel No. 15567) from the published Panel of Statutory Auditors (2026–2028) in compliance with the Bombay High Court ruling.
Re-Audit Affected Societies: Order a mandatory re-audit under Section 81 of the MCS Act, 1960 for all housing societies audited during de-panelment proceedings.
Mandate Strict Due Diligence: Institute mandatory, transparent background verification protocols before finalizing future auditor panels so citizens are guaranteed only verified and tested auditors.
WHY YOUR SIGNATURE MATTERS:
If de-paneled auditors remain on official government panels, any housing society could unknowingly appoint a disqualified auditor, putting building funds and audit integrity in jeopardy.
Sign this petition to demand accountability, enforce High Court orders, and protect our housing society funds!
