Protect Genuine International Students Affected by the New Student Visa Rules

The new Student visa rules that started on 2 October 2026 will affect many international students who had already changed their course or provider before these changes came in.

The concern is not about people misusing the Student visa system.

The concern is about genuine students who made lawful decisions based on the rules that applied at the time.

Many students had already:

  • changed their course for a genuine reason;
  • moved to a different provider;
  • received a new CoE;
  • paid tuition fees;
  • started studying their new course; and
  • planned their future around that study pathway.
  • For some students, the course change happened because the original course was not suitable, their career plans changed, they had problems with their provider, or they found a course that better matched their future goals.

These decisions were made legally and in good faith.

Now, because of the new rules, some of these students may not be able to apply for their next Student visa while they are in Australia.

They may have to leave Australia even though they are already studying here and have already invested significant time and money into their education.

How can this affect genuine students?
They may face:

  • interrupted studies
  • extra flights and accommodation costs
  • loss of tuition fees
  • uncertainty about whether they can return
  • difficulty completing a course already started
  • financial and personal stress
  • The rules may have changed now, but these students made their decisions before the new rules existed.

What are we asking for?
We are asking the Australian Government to consider a fair transitional arrangement for students who had already made genuine course or provider changes before 2 October 2026.

This could include students who:

  • already had a new CoE before the changes;
  • had already started their new course;
  • had a genuine reason for changing course or provider;
  • have followed their visa conditions; and
  • are not repeatedly changing courses just to stay in Australia.


Where a general exemption is not possible, there should at least be a case-by-case option for genuine students.

This is not about removing the new rules
Strong Student visa rules are important.

Students who misuse the system should be dealt with appropriately.

But genuine students who followed the rules that existed at the time should not be caught unfairly because the rules changed later.

A fair transition can protect both Student visa integrity and genuine international students.

Our request is simple
Protect the system, but also protect genuine students who made lawful decisions before 2 October 2026.
