IT SEEMS IF A PUBLIC OPEN SPACE IS LEASED TO SOMEONE PUBLIC ACESS MUST BE MAINTAINED AND THE ENTITY CAN NOT BLOCK PUBLIC ENJOYMENT
Leased to a Third Party: If a local council leases out part of an existing public open space (such as to a sports club or café), public access usually must still be maintained under statutory trust rules, though certain areas can be fenced or regulated
Restrictions and Rules: The entity managing the space may enforce local bylaws or reasonable conditions, but they cannot completely block public enjoyment unless the lease legally allows for a change in use or disposal via statutory procedures
