Manchester city council refuse ePetition
Your Online petition PUBLIC PARK SHOULD BE OPEN DAYTIMES has been rejected because it discloses material which is otherwise commercially sensitive.
All Saints Park was leased by Manchester City Council to Manchester Metropolitan University (MMU) in 1993. Under the terms of that lease, MMU is responsible for the day-to-day management and maintenance of the park.
The lease includes a user clause requiring the land.
"To be used solely as a public open space as defined by the Town and Country Planning Act 1990 and for no other purpose whatsoever."
The Council's understanding, is that whilst the lease secures the site's use as public open space, it does not contain specific provisions relating to the park's opening hours or day-to-day operational management. Those matters therefore fall within MMU's responsibilities as lessee and manager of the site.
As a result, decisions relating to access arrangements and opening times are matters for MMU.
