25 PUNTOS PARA ERRADICAR LA VIOLENCIA HACIA LOS OTROS ANIMALES EN MÉXICO

La regulación del trato ético y respetuoso a los animales así como de su entorno y de sus derechos esenciales, entre otros, son vulnerados día tras día por las mismas autoridades al no aplicar las leyes, reglamentos y normas relacionadas, promoviendo con esto el escalamiento de la violencia intrafamiliar y hacia otros seres sintientes. Se ha comprobado que la mayoría de los asesinos seriales han torturado y asesinado animales desde su infancia.

Por ello, resulta indiscutible la necesidad de prevenir y detener, por todos los medios que estén al alcance, toda forma de violencia animal, así como la depredación de las áreas naturales.

Lo anterior, con el fin de construir una sociedad con valores de equidad, justicia y empatía hacia todas las especies y con ello disminuir los graves índices de violencia de los cuales todos somos parte y víctimas.

Por lo que es urgente e inaplazable que se lleven a cabo las siguientes acciones a nivel nacional:

1. Los animales deben de cambiar de estatus jurídico: de cosas a seres sintientes sujetos de derechos y consideraciones morales.

2. El maltrato animal debe estar tipificado como delito con fuertes penas y sanciones.

3. Dar estricto cumplimiento a todos los cuerpos legales en materia de bienestar y protección animal –leyes, reglamentos, acuerdos, normas, circulares– en todos los temas referentes a los animales de: compañía, de los explotados para el consumo humano (rastros clandestinos, rastros de traspatio), en la experimentación, en los espectáculos acuáticos y terrestres, en trabajos forzados, en exhibición, entre otros. Actualmente, en toda la República Mexicana, los castigos y sanciones por violencia hacia los animales son inexistentes. Esto se debe a la falta de profesionalización, capacitación y sensibilización de los servidores públicos.

4. Se debe realizar un registro nacional de delincuentes y agresores de animales y de la naturaleza.

5. Es vital que todas las entidades de la República Mexicana cuenten con una Ley de Protección/Bienestar Animal y su reglamento vigente.

6. Se debe profesionalizar, capacitar e impartir talleres de actualización constante por personal calificado a las autoridades; los ministerios públicos; los jueces; los policías federales, estatales y municipales; los inspectores y demás personal operativo encargado de aplicar las leyes y normas en materia de protección/bienestar animal.

Asimismo, se deberá contar con el apoyo de la policía cibernética quien deberá contar con el conocimiento legislativo y operativo para los casos de maltrato y violencia hacia los Animales No Humanos y la Naturaleza.

7. Se necesita nombrar a la autoridad que regirá a las Presidencias Municipales a nivel nacional para que éstas apliquen de forma rigurosa las Leyes de Protección a los Animales y/o cualquier norma o reglamento relacionados con el bienestar animal, ya que actualmente no hay autoridad que los obligue a actuar y por ende no lo hacen.

8. Es necesario crear el Instituto Federal de Protección Animal, mismo que deberá tener línea directa a su vez con institutos estatales y municipales.

9. En indispensable abolir las prácticas y actividades atávicas y violentas, aunque sean consideradas costumbres o tradiciones como lo son: la tauromaquia, las peleas de gallos, la charrería, los espectáculos con animales acuáticos, los rituales religiosos, entre otros.

10. Es urgente dar cumplimiento a las obligaciones que México ha adquirido al ser firmante de la Convención de los Derechos de la Niñez, la cual se ha pronunciado de forma expresa en contra de que los niños, niñas y adolescentes menores de 18 años participen o asistan a eventos taurinos. De igual forma, también lo señala la Constitución Política de los Estados Unidos Mexicanos; la Ley General de Niñas, Niños y Adolescentes en cuanto al derecho a una vida libre de violencia que los niños y jóvenes tienen como uno de sus principales derechos humanos.

11. Es fundamental que se etiqueten partidas y presupuestos a nivel federal destinados a erradicar la violencia hacia los animales, así como implementar programas permanentes por entidad para difundir la cultura del trato respetuoso hacia todos los animales.

12. Es vital establecer campañas de esterilización itinerantes, gratuitas o a bajo costo, masivas y obligatorias, durante los 365 días del año.

13. Es de suma importancia incluir en todos los libros de texto gratuitos de las escuelas de nivel básico, preescolar, primaria, secundaria y nivel superior el tema de la protección y respeto a la vida animal y prevención de la violencia.

14. A fin de conocer más certeramente la situación de animales domésticos en nuestro país, solicitar la inclusión de dicho tema en los Censos realizados por el INEGI, ya que de esta forma sabremos realmente si se avanza en la disminución de animales en situación de calle.

15. Es urgente que se prohíba la venta de todo tipo de especies animales para frenar la violencia, el abandono, el hacinamiento y la sobrepoblación de animales en situación de calle.

16. Es necesario tipificar como delito a la zooerastia.

FAUNA SILVESTRE

17. Se deben implementar acciones y sanciones contundentes para el combate del comercio ilegal de especies silvestres. De igual forma, establecer una regulación estricta y aplicación de vedas a la venta legal de animales.

18. Se tienen que realizar inspecciones estrictas, constantes y recurrentes a las Unidades de Manejo para la Conservación de Vida Silvestre (UMAS).

19. Es necesario dejar de considerar la caza como herramienta de conservación, prohibirla y en su lugar apoyar el turismo sostenible, el cual sí aporta a la conservación.

20. Se debe prohibir que individuos de fauna silvestre sean utilizados como animales de compañía y en espectáculos acuáticos y terrestres, así como que se exhiban en espacios urbanos y artificiales para satisfacer la observación de curiosos –tocar y fotografiarse– y sancionar fuertemente a los infractores.

21. Es fundamental comenzar con la conversión paulatina de los zoológicos a centros de resguardo, rehabilitación y conservación de la fauna silvestre mexicana. Para ello, es necesario dejar de reproducir, exhibir e intercambiar especies exóticas. Respecto a los animales que se encuentren ya en esos sitios, se debe valorar su estado de salud e impronta y con ello considerar la pertinencia de buscar espacios más adecuados y trasladarlos. De lo contrario, se les deben ofrecer las mejores condiciones (considerando aspectos de salud básica, modo de vida natural y estados afectivos, propios de cada especie) hasta que terminen su ciclo de vida.

22. Se necesita dar cumplimiento a las leyes, reglamentos y normas relativas al cambio de uso de suelo en Áreas Naturales Protegidas –Zonas de Conservación o de vocación forestal a urbanas, ganaderas y mineras– para asegurar la conservación de los espacios naturales y los hábitats de la fauna silvestre.

23. Es vital promover actividades productivas acorde a la conservación de la fauna y flora silvestre.

24. Es de suma importancia implementar campañas informativas para el conocimiento y respeto de la fauna silvestre –en todos los niveles y en comunidades rurales y urbanas– en las cuales se eliminen mitos y creencias que ocasionan la depredación, exterminio y violencia hacia diversas especies, por ejemplo: los murciélagos, los lobos, las serpientes, las lechuzas, entre otros.

25. Es indispensable asegurar el presupuesto, herramientas de trabajo y personal profesionalizado y capacitado para la realización de todo lo anteriormente expuesto.

Es indispensable que se promueva la alimentación basada en plantas, en todos los sectores,misma que está reconocida por Organismos Internacionales de Salud. Esto ayuda a nuestra salud y al Medio Ambiente, y conjuntado con una Educación Antiespecista, ayudará al humano a entender que sus vidas No nos pertenecen y dejaremos --esperamos en poco tiempo--, de explotar y asesinar a MILES DE MILLONES de Animales No Humanos, cuyas vidas merecen consideración moral y derecho a vivir libres y en paz.

El trabajo que realizamos es por nuestro país, por una comunidad sana, ética, libre de violencia, a través de la aplicación de marcos regulatorios que nos permitan construir una sociedad de paz.

Asimismo, se debe tomar en cuenta que las asociaciones y grupos independientes de defensa animal en México que cuentan con refugios y santuarios están saturados, y de sus propios recursos o mediante donativos auxilian a los animales.

25 POINTS TO ERADICATE VIOLENCE TO THE OTHER ANIMALS IN MEXICO

The regulations regarding the ethical and respectful treatment of animals as well as of their environment and their essential rights, among others, are violated day after day by the authorities themselves by not applying the law, promoting with this the escalation of family violence as well as towards other sentient beings. It has been proven that most serial killers have tortured and killed animals since childhood.

Therefore, the need to prevent and stop –by all means available– all forms of animal violence as well as the depredation of natural areas is indisputable.

The above is necessary in order to build a society with values of equality, justice, and empathy towards all species and thereby reduce the serious rates of violence of which we are all part and victims.

Therefore, it is urgent that the following actions are carried out at the national level:

1. The legal status of animals must change from things to sentient beings subject of rights and moral considerations.

2. Animal abuse must be classified as a felony with heavy penalties and sanctions.

3. Comply strictly with all animal welfare and protection statutes in all matters relating to companion animals, animals exploited for human consumption (clandestine slaughterhouses, backyard abattoirs), in experimentation, in aquatic and terrestrial shows, in forced labor, and on display, among others. Currently, throughout the Mexican Republic,

punishments and sanctions for violence against animals are non-existent. This is due to the lack of professionalization, training, and awareness of public servants.

4. A national registry of offenders and aggressors of animals and nature must be created.

5. It is vital that all Mexican states have an Animal Protection/Welfare Law and regulations.

6. Professionalization, training, and ongoing updating workshops must be provided by qualified personnel to the authorities; public prosecutors; judges; federal, state, and municipal police; inspectors, and other operative personnel in charge of applying animal protection/welfare regulations.

Likewise, the support of the cyber police is of utmost importance; it must have the legislative and operational knowledge for cases of abuse and violence towards non-human animals and nature.

7. It is imperative to appoint the authority that will oversee municipalities across the country so that they rigorously apply the Animal Protection Laws and/or other statutes related to animal welfare, since there is currently no authority that forces them to act.

8. It is necessary to create the Federal Institute for Animal Protection, which must have direct contact with state and municipal institutes.

9. It is essential to abolish atavistic and violent practices and activities –even if they are considered customs or traditions– such as bullfighting, cockfighting, charrería, shows with aquatic animals, and religious rituals, among others.

10. It is urgent to comply with the obligations that Mexico has acquired by signing the Convention on the Rights of the Child, which is expressly against the attendance of children and teenagers under 18 to bullfighting events. Likewise, both the Mexican Constitution and the General Act for Girls, Boys, and Adolescents recognize the right to a life free of violence as one of the main human rights of this population.

11. It is essential to allocate federal resources for the eradication of violence towards animals, as well as to implement permanent state programs to spread a culture of respectful treatment towards all animals.

12. It is vital to establish itinerant sterilization campaigns –free or at low cost, massive and obligatory– 365 days a year.

13. It is of the utmost importance to include in all free textbooks of all educational levels the subjects of protection and respect for animal life, and prevention of violence.

14. In order to know more accurately the situation of domestic animals in our country, request the inclusion of this topic in the Census conducted by INEGI. This way we will know if there is progress in the decrease of stray animals.

15. It is urgent to ban the sale of all types of animal species in order to halt the abandonment, hoarding, overpopulation, and the violence homeless animals are subjected to.

16. It is necessary to classify zoophilia as a felony.

WILDLIFE

17. Forceful actions and sanctions must be implemented in order to combat illegal wildlife trade. Likewise, establishing strict regulations and application of closures to the legal sale of animals.

18. Strict, constant and recurrent inspections need to be carried out regarding Management Units for the Conservation of Wildlife (UMAS).

19. It is necessary to stop considering hunting as a conservation tool, as well as ban it altogether and support sustainable tourism instead, which does contribute to conservation.

20. It should be prohibited to use wildlife species as home pets and as entertainment in aquatic and terrestrial shows, as well as to exhibit them in urban and artificial spaces to satisfy the observation of the curious (touching and taking pictures). Offenders should be harshly punished.

21. It is essential to begin with the gradual conversion of zoos into shelters and rehabilitation/conservation centers for Mexican wildlife. To achieve this, it is necessary to stop reproducing, exhibiting and exchanging exotic species. Regarding the animals living already in those sites, assessing their health and imprinting status is of the uttermost importance in order to consider the possibility of finding more suitable spaces for them and move them there. If not an option, the best possible conditions should be offered (considering species-specific basic health, natural living and affective states) until they finish their life cycle.

22. It is necessary to comply with all statutes related to land use changes in Natural Protected Areas –Conservation Zones or forest vocation lands to urban, farming, and mining land– in order to ensure the conservation of natural spaces and wildlife habitats.

23. It is vital to promote productive activities consistent with the conservation of wild fauna and flora.

24. It is important to implement information campaigns for the knowledge and respect of wildlife –at all levels and in both rural and urban communities– that help eliminate myths and beliefs that cause predation, extermination, and violence towards various species such as bats, wolves, snakes, and owls to name a few.

25. It is necessary to secure the budget, work tools, and qualified staff in order to perform all of the above.

It is essential to promote a plant-based diet, which is already recognized by International Health Organizations, in all sectors. It improves our health and helps the environment, and along with an Antispeciesist Education, it will help humans understand that the lives of other animals do not belong to us, in the hope that eventually, we will stop exploiting and killing BILLIONS of Non-Human Animals who deserve moral consideration and the right to live Free and in Peace.

The work we do is for our country, for a healthy, ethical, and violence-free community, through the application of regulatory frameworks that will allow us to build a society of peace.

Likewise, it must be taken into account that the associations, animal defense independent groups that have shelters and sanctuaries are saturated, and of their own resources or through donations help the animals.
