Hello All,
We are pleased to inform you that the judge signed the Temporary Restraining Order (TRO) yesterday, Monday, August 25! This is a significant development on multiple fronts, and we will provide a more detailed overview during our scheduled meeting on Thursday at 6:30pm. While this represents an important first step, we must also recognize that there is still considerable work ahead.
Special Note: As of 3pm on Tuesday, August 26, ALL defendants have been served the TRO in person. They understand that it is NOW a violation of judge's orders to continue work. We have gotten several reports of work happening today. One worker told someone that they are in the process of installing an erosion barrier to protect against mud and other debris from entering the adjacent properties and creek in the event of rain. Regardless, IF YOU SEE SOMETHING, PLEASE TAKE A PHOTO OR VIDEO AND NOTE THE TIME AND DATE.
Please submit ALL evidence to preservelakeridge@gmail.com.
Given the substantial financial interests at stake for the developer, we should anticipate a vigorous defense on their part. In light of our fiduciary responsibilities, it is critical that we prepare now for the legal challenges ahead. To that end, we are establishing a fundraising committee to assist in raising the resources necessary to sustain this effort. If you are interested in serving on this committee, please let us know at the Thursday meeting or by sending a message to preservelakeridge@gmail.com.
The preliminary injunction hearing is currently scheduled for Monday, September 8th at 2:00pm, though this date may be extended by up to 14 days at the request of the defendants. Several residents have already agreed to provide testimony at the hearing, and we encourage others who may be impacted to consider participating as well.
In support of granting the TRO, the judge specifically stated on page 3:
“If the temporary restraining order does not issue, Plaintiff and the residents of the Lake Ridge community will be irreparably injured in that they will suffer the negative impact in the use and value of their properties, for which injuries no legal remedy exists.”
This underscores the importance of our collective efforts. If you are willing to testify regarding how the proposed development may negatively impact your property or quality of life, please notify us.
