Monsieur le Haut-Commissaire des Nations Unies aux droits de l'homme Volker Türk,

Messieurs Dames les rapporteurs spéciaux du Conseil des droits de l'homme compétents en matière des droits des migrants, de détention arbitraire, de torture et de droit à la santé,

Tout citoyen engagé et préoccupé par la situation actuelle.

Nous, soussignés, exprimons notre vive préoccupation face aux violations répétées des droits humains imputables aux pratique de l'Immigration and Customs Enforcement (ICE), agence fédérale américaine. 

De nombreuses sources concordantes font état notamment de :

• détentions arbitraires et prolongées, sans contrôle judiciaire effectif ;
• conditions de détention inhumaines, incluant le surpeuplement, l'isolement prolongé et l'accès insuffisant aux soins médicaux ;
• négligences médicales graves, ayant conduit à des atteintes irréversibles à la santé, voire à des décès ;
• séparations familiales et atteintes disproportionnées au droit à la vie privée et familiale ;
• pratiques discriminatoires et violences sexuelles, notamment à caractère racial ou ethnique.

Ces faits, lorsqu'ils sont établis, sont susceptibles de constituer des violations des obligations internationales des États-Unis, en particulier au regard du Pacte international relatif aux droits civils et politiques, entrée en vigueur le 23 mars 1976 et signé et ratifié par les États-Unis, et de la Convention contre la torture, entrée en vigueur le 26 juin 1987 et signée et ratifiée par les États-Unis. 

Nous demandons respectueusement aux mécanismes compétents du Conseil des droits de l'homme :

1. L'ouverture d'un examen approfondi des pratiques de détention et d'éloignement mises en oeuvre par l'ICE ;
2. L'envoi de communications officielles au gouvernement des États-Unis afin d'obtenir des explications et des garanties de non-répétition ;
3. La formulation de recommandations publiques visant à assurer la conformité des politiques migratoires avec les normes internationales relatives aux droits humains ;
4. Un accès effectif et indépendant des mécanismes de contrôle, ONG et observateurs aux lieux de détention relevant de l'ICE. 

La protection des droits fondamentaux des personnes migrantes n'est ni optionnelle ni circonstancielle. Elle constitue une obligation juridique internationale et un test de crédibilité pour l'engagement des États en faveur de l'État de droit. Au-delà des obligations juridiques, il s'agit d'une question d'humanité et de respect de la dignité inhérente à toute personne.

Nous appelons les Nations Unies à exercer pleinement leur mandat afin que cessent ces pratiques barbares et que la responsabilité des autorités concernées soient engagée.

Any citizen who is engaged and concerned about the current situation.

We, the undersigned, express our serious concern regarding repeated human rights violations attributable to the practices of U.S. Immigration and Customs Enforcement (ICE), a federal agency of the United States.

Numerous credible sources have documented, inter alia :

• Arbitrary and prolonged detention, often without effective judicial oversight ; 
• Inhuman conditions of detention, including overcrowding, prolonged solitary confinement, and inadequate access to medical care ;
• Serious medical neglect, resulting in irreversible harm to health and, in some cases, death ;
• Family separations and disproportionate interferences with the right to private and family life ;
• Discriminatory practices and sexual violences, including those based on race or ethnicity.

Where established, such practices may constitute violations of the international obligations of the United States, in particular under the International Covenant on Civil and Political Rights and the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.

We respectfully call upon the relevant mechanisms of the Human Rights Council to :

1. Undertake a thorough review of detention and removal practices carried out by ICE ;
2. Address official communications to the Government of the United States seeking clarification and guarantees of non-repetition ;
3. Issue public recommendations to ensure that U.S. immigration enforcement policies comply with international human rights standards ;
4. Ensure independent and effective access for monitoring bodies, non-governmental organizations, and observers to ICE detention facilities.

The protection of the fundamental rights of migrants is neither optional nor contingent. It constitutes a binding international legal obligation and a test of credibility for States’ commitment to the rule of law. Beyond legal obligations, this is a matter of humanity and respect for the inherent dignity of every person.

We urge the United Nations to fully exercise its mandate to ensure that these practices cease and that the responsibility of the relevant authorities is duly engaged.
